LEGAL GUIDE FOR PROTECTING FASHION DESIGNERS
In the ever-evolving landscape of fashion, where innovation meets legal intricacies, securing the intellectual property of designers is a paramount concern.
How can protection be achieved?
- TRADEMARK
a. Engage a qualified IP lawyer.
b. Ensure that their brand name, mark, and logo are distinctive and not descriptive or deceptive.
c. Register the marks with the Trademarks Registry.
d. Monitor and renew the trademarks registration.
- INDUSTRIAL DESIGN:
a. Engage a qualified IP lawyer.
b. Ensure that the design is novel and does not fall into the public domain--including posting on social media. Also, the design must not be contrary to public morality.
c. Register the design with the Patents and Designs Registry. This entails submitting design renderings and paying the necessary fees. Design registration is valid for 5 years, with the option of renewing for two additional 5-year periods. Designers must be aware of renewal requirements to ensure long-term protection.
- COPYRIGHT:
a. Ensure that all sketches are original ideas.
b. Keep detailed records of the design process; from idea sketches to the finished product---this strengthens a designer's position in the event of a legal dispute.
c. Register sketches with the Nigeria Copyright Commission
- VIGILANCE AND ENFORCEMENT: While legal frameworks lay the groundwork for protection, designers must actively assess the market for potential infringements. The importance of timely enforcement of rights through legal action cannot be overstated. Engaging legal experts who are knowledgeable about intellectual property law in Nigeria will help navigate complications and ensure efficient enforcement.
