Shan Mohmmed v. Apple India (Case No. 122/2023)
The South Delhi District Consumer Disputes Redressal Commission recently ordered Apple India to pay ₹1 lakh compensation to a consumer whose stolen iPhone 13 could not be tracked using the “Find My” feature, despite a message claiming it was “findable after power off.”
This ruling highlights Apple’s failure to clearly disclose prerequisites for the feature.
The bench (President Monika A Srivastava and Member Kiran Kaushal) found Apple guilty of service deficiency for not prompting users to enable “Find My” or attaching visible disclaimers/asterisks to the message. They stated: “The user would take the statement (‘iPhone findable after power off’) to be true and a complete statement as there is no pre-condition attached to it.” No refund was granted, but ₹1 lakh compensation was awarded.
