A fellow Realtor told me their recent buyers closed on a house with a pool. They were excited because their kids had been asking when they could finally use it. The day after closing they planned a small celebration with family coming over to swim.
The contract stated possession would transfer at closing. Keys were handed over and legally the house belonged to the buyers.
They showed up the next day with their kids and family ready for the pool day. When they pulled into the driveway they noticed the sellers’ cars were still there. They assumed the sellers might just be finishing some last minute packing.
They unlocked the door and walked inside.
The sellers were still there. Furniture in the living room. Boxes everywhere.
The sellers looked surprised to see them.
The buyers explained they had closed the day before and this was their house now. The sellers said they were not finished moving and needed a few more days.
The buyers were shocked.
Possession was supposed to transfer at closing.
Meanwhile the family had already arrived for the pool day and the kids were outside disappointed they could not swim. The buyers called their agent immediately asking what to do.
The agent contacted the listing agent who confirmed the sellers knew possession was at closing. They had simply assumed they would have more time and never communicated it to anyone.
It took three days before the sellers finally moved out. The buyers had to cancel the pool day and reschedule their movers.
A simple misunderstanding created unnecessary stress and delays.
Always make sure possession terms are clear in writing and confirm the property is vacant before planning move in day.
Comment POSSESSION if you know the difference between closing and move in.
