On H-1B (or about to be)? Your next extension could get a lot harder. ⚠️
DHS released a proposed rule on Oct 13 to end “deference”:
• Today: same employer, same facts → USCIS generally defers to its earlier approval
• Proposed: every extension reviewed like a brand-new petition, with fresh evidence on things already accepted
• Covers H-1B, L-1, O-1 and other work-visa extensions
✅ It’s only a proposal. Nothing has changed yet.
💬 Public comments are open until Nov 13, 2026.
Extension coming up? Ask your employer to document everything like it’s the first filing.
