One of the major consequences of sensationalised media coverage and the public’s growing tendency to question and vilify the medical fraternity is the increasing fear of litigation among doctors.

Ironically, this often ends up hurting the very patients who need medical care the most. When treating a high-risk or complicated case carries the constant threat of legal battles, some doctors may understandably hesitate to take it up. The result? Patients being referred from one hospital to another, with no one willing to accept responsibility for a case that carries significant risks.

Medicine has never been without uncertainty, and not every adverse outcome is the result of negligence. Sometimes, despite the best intentions, sound clinical judgment, and every possible effort, things can go wrong.

When the fear of litigation begins to outweigh the willingness to take calculated clinical risks, it is ultimately the patient who suffers.

Because, at the end of the day, sometimes a peaceful night’s sleep is worth far more than the money one earns by taking on a case.
