Dr Charlotte Proudman secured one of the first published judgments to define and apply the term “gaslighting” — recognising it as a form of domestic abuse.

Gaslighting is a covert type of emotional abuse where the abuser creates a false narrative and makes the victim question their judgment and reality.

Dr Proudman represented “Denise”, who was suffering through a family court battle with the father of her child, a man who had raped and abused her.

During proceedings, the perpetrator attempted to frame her as the stereotype of an irrational woman and destroy her credibility and the credibility of her allegations.

A family court judge had told Denise that he would have her daughter removed from her, adopted and placed in care if she continued with her allegations. Dr Proudman took Denise’s case to appeal to challenge the perpetrator’s application for contact with their daughter.

At a fact-finding hearing, Cobb J (as he then was) made findings of sexual assault and emotional manipulation that had caused Denise “severe anxiety, depression, and trauma”. Significantly, he held that Dr Proudman’s use of the term “gaslighting” to describe the father’s conduct as “apposite”.

The judge ordered a hearing into the impact of this abuse on Denise and her daughter to determine a future arrangement order. At this point, the perpetrator dropped his case and stopped seeking contact.

Abusers have long been warping victims’ realities, but there had previously been no legal term for it. The judge’s use of the term gaslighting gives victims a language for the harm they suffer.

Proudmans is a specialist family law firm founded by Dr Charlotte Proudman to represent survivors of abuse. We ensure our clients receive excellent, trauma-informed representation as well as the benefit of a firm shaping the law.
