In a disturbing revelation raising questions about political accountability and women’s safety, 187 sitting MPs and MLAs across India have declared criminal cases related to crimes against women, including 14 lawmakers with rape-related cases, according to a report released by the Association for Democratic Reforms (ADR) on October 23, 2026. The report analysed election affidavits of 4,881 elected representatives, including 772 MPs and 4,109 MLAs. Of the 187 lawmakers who disclosed such cases, 168 are MLAs and 19 are MPs. The BJP accounts for the highest number, with 106 lawmakers, followed by Congress with 20 and the Telugu Desam Party (TDP) with 18. However, as a proportion of each party’s legislative strength, TDP leads at 11.6%, compared with BJP’s 4.9% and Congress’s 2.6%. State-wise, West Bengal tops the list with 69 MPs and MLAs, followed by Andhra Pradesh with 22 and Odisha with 17. Even more concerning, 14 elected representatives have declared rape-related cases, including two Lok Sabha MPs and 12 MLAs. BJP and Congress account for four lawmakers each in this category. The findings have renewed scrutiny of political parties’ candidate selection processes, particularly when elected representatives are responsible for framing laws intended to protect women. ADR has called for stricter measures against candidates with criminal backgrounds, faster trials and greater accountability from political parties. Importantly, these figures are based on cases disclosed in election affidavits and do not establish guilt or conviction. The current status of individual cases may have changed since the affidavits were filed.
