BREAKING NEWS 🚨: In a major setback for Indian IT companies and millions of people seeking permanent residency in America, the Donald Trump administration has suspended eight technology giants, including Infosys, Tata Consultancy Services (TCS), Wipro, HCL Technologies, Cognizant, Capgemini, Microsoft and Adobe, from the US Permanent Labour Certification (PERM) programme.

The announcement was made on October 8 by US Labour Secretary Keith Sonderling, alongside Vice President JD Vance, as Washington intensified its crackdown on alleged misuse of employment-based immigration programmes.

Under the decision, the US Department of Labour will stop accepting new permanent labour certification applications and processing pending applications involving these companies.

But what does this mean for Indian employees?

The PERM programme is a crucial step towards obtaining employment-based Green Cards, which allow foreign nationals to live and work permanently in the United States. Companies must generally demonstrate that no qualified American worker is available for a particular position before sponsoring a foreign employee.

Importantly, the suspension does not mean that existing H-1B visas or Green Cards have been cancelled. H-1B visas are part of a separate programme that allows US employers to temporarily hire foreign professionals. However, the move could disrupt the path to permanent residency for thousands of employees.

Defending the decision, Sonderling claimed that the affected companies had collectively requested nearly three million foreign workers since 2009, receiving more than 230,000 H-1B approvals and over 100,000 permanent labour certifications.

The administration raised concerns over alleged immigration fraud and the displacement of American workers, although the allegations do not establish wrongdoing by every company involved.

Vice President JD Vance also questioned Microsoft’s hiring practices, pointing to layoffs of American employees while foreign workers continued to be employed.

The decision could significantly affect India’s IT industry, whose leading companies employ thousands of professionals in the United States.
