On Friday night, while Poland’s elected president was in the air on his way to Senegal, the police moved on the Constitutional Tribunal in Warsaw. Officers cordoned off the building, took control of the empty headquarters, and refused entry to the court’s own security staff, its vice president, and its director. Hours earlier, a judge who has never taken the oath of office before the president had signed an order suspending the court’s lawful president and vice president. The court itself answered on its own channels: an illegal takeover, and anyone taking part in it is committing the crime of coup d’état.

President Karol Nawrocki turned his plane around mid-flight. “In such a moment, the president must be in Poland,” he wrote. “I am returning.” He had refused to swear in three judges imposed by the parliamentary majority, and the court’s president had refused to seat them, and that refusal was the last check on a prime minister who promised to restore his version of order by any method the state allows. The standoff had been building for weeks: police pushing protesters from the court, a prosecutor demanding the court’s tapes, a judge sworn in before an empty chair. Friday night was the moment the methods ran out of patience.

Donald Tusk calls it the restoration of the rule of law. The court calls it a coup. The opposition leader calls it a coup. The institute that defends Poland’s constitution cites the penal code: up to twenty years for removing a constitutional body by force. Poland did not vote for this. More than ten million Poles elected Nawrocki last year, and the prime minister who lost that election just sent the police to seize the court that stood in his way. Europe is watching. So is every voter who still believes a ballot beats a baton.
