Reality star and criminal justice reform advocate Kim Kardashian is brining some attention to California’s newly enacted juvenile justice legislation this week, using her platform to raise a broader structural question: “Why do we even incarcerate kids at all????”
___________________________________________________
The comment, posted to Kardashian’s IG Story alongside a news report on Assembly Bill 1646, reframed the public debate surrounding California’s “Hug Act.” Signed into law by Gov. Gavin Newsom, AB 1646 makes California the first state in the nation to establish a statutory right for youth in juvenile detention facilities to engage in consensual physical contact such as hugging and hand-holding with visitors. Under the new law, physical contact cannot be arbitrarily denied or used as a blanket disciplinary measure. Facilities may only restrict physical contact if an immediate safety threat exists, and any limitations must be formally documented.

While the legislation has been celebrated as a milestone for juvenile rights, Kardashian’s reaction pointed out a lingering tension in the reform movement, she questioned the very premise of locking up children, though she offered no alternative framework for housing, rehabilitating, or disciplining youth accused of serious crimes.
