Prosecutors in New York are reopening a criminal investigation into an alleged gang rape at a Cornell frat house in 2024. A former student has sued the school and seven Chi Phi members in a civil suit after a Cornell Title IX investigation resulted in no criminal charges.

The complaint alleges Jane Doe, 20, left her sorority house after drinking ten drinks to meet a friend at Chi Phi’s frat house, where she was given more alcohol and ketamine, then sexually assaulted while unable to consent. A “Chi Phi Actives” group chat allegedly invited members upstairs for “free p—y” where the assault continued for several hours until around 5:45 a.m.

After the school’s Title IX investigation, Doe’s attorney says the school expelled two of the “Cornell 7” and gave others lighter punishment like writing essays. Cornell says the students received sanctions including expulsions and suspensions and none “were offered the opportunity to write essays as a sole consequence.”

The Tompkins County DA says the lawsuit’s allegations are “dramatically different” from the original police report, while her attorney says it was “not materially different” arguing Doe was never properly interviewed by investigators.

Cornell says it has barred the fraternity’s campus chapter, launched a sexual assault task force and supports reopening the case.

“Any suggestion that the university did not impose consequential punishments for those involved is false,” Cornell’s statement concludes. “A continuation of the false narrative that there were minimal consequences in this case is irresponsible, will make survivors feel less safe and supported, and will perpetuate the underreporting of sexual assault.”
