I think people are confused. He didn't own the apartment, her name wasn't on the lease because if it was she would have to be there to break it too. Therefore when he moved out anything left there would of been thrown out. You can sue anyone for anything but doesn't mean you will win or that it will ever see the inside of a courtroom. A lawyer would take your case because win or lose you owe them money.
