A Fulton County judge has ruled that Johnathan Hamby, 54, is not competent to stand trial in connection with the fatal stabbing of 29 y/o Ramon “Rah” Harris that occurred on the Beltline back in August.

According to Fulton County Superior Court records, a judge ruled on Oct. 13 that Hamby is not competent to stand trial and he will now be moved to the court’s competency docket.

Hamby is scheduled to appear in court for a pre-indictment preliminary hearing on Dec. 17, 2026, followed by a status conference on Feb. 11, 2027. He is also seeking new legal counsel. As of Wednesday, Hamby remains in custody at the Fulton County Jail.

Following his arrest, Hamby’s family released a statement saying he has a long history of severe mental illness and active psychosis. Hamby has been previously arrested 30+ times.

If they aren’t competent enough to stand trial how are they competent enough to be out in public?

Not competent to stand trial means not competent to walk free ever again. Law abiding citizens should not be forced to walk the streets with people like this around us.

This is ridiculous if there is such evidence then he should be permanently institutionalized in a high supervision system not let out into the streets with such excessive and continuous behavior what is the family talking about now

Another example of our justice system failing us because it’s too lazy to apply law to a case! What are they going to do with him since he can’t even face a trial for murder? Release him back out? That’s what Atlanta courts do best!

And he’s not especially given his background. He is really mental. The situation is sad but this is the world we live in.
