SC/ST Act में मुकदमा कब दर्ज होता है और कब नहीं? 🤔⚖️
A very common misconception is that any casteist remark automatically leads to an FIR under the SC/ST (Prevention of Atrocities) Act. But the law has a very specific condition!
In the landmark judgment of Hitesh Verma v. State of Uttarakhand (2020), the Supreme Court clarified that the insult must occur in "Public View" (सार्वजनिक दृष्टि).
Key Takeaways from the Reel:
🏢 Closed Doors: If an argument happens inside a house with no outside witnesses, this Act does not apply.
👁️ Public View vs. Public Place: You don't need to be in a market! Yelling from your private balcony where neighbors can hear you counts as "Public View."
📱 Private Chats: Personal messages or closed-door conversations don't fall under this Act unless there is an Independent Witness (family members don't count).
The true purpose of the law is protection, not harassment. Let's respect each other, avoid using derogatory remarks, and prevent the misuse of legal provisions. Samaj mein prem banaye rakhein! 🤝🇮🇳
