⚖️ SIGNIFCANT RULING ON MENTAL CRUELTY
The Madras High Court has upheld a divorce decree, ruling that a wife's frequent, unjustified visits to her maternal home—combined with persistent pressure on her husband (an only son) to abandon his parents—constitutes mental cruelty.
A division bench comprising Justice P.T. Asha and Justice N. Mala observed that marriage is a reciprocal partnership. The court highlighted that forcing a husband to abandon his aging parents when he is the sole caregiver creates immense emotional stress and insecurity.
The bench noted that such frequent, prolonged separations leave a spouse living under the constant fear that their partner might "pick up a fight and leave at the drop of a hat," fundamentally breaking the foundation of the matrimonial bond.

Can a maintenance case keep running for years?
A recent Supreme Court decision has put the spotlight on an important issue: maintenance proceedings should not be allowed to drag on indefinitely.
The bigger takeaway is that courts need to deal with maintenance claims efficiently and consider the facts of each case rather than allowing proceedings to remain unresolved for years.
But there’s an important distinction:
👶 Children’s maintenance is a separate issue and remains governed by their legal entitlement and welfare.
⚖️ Spousal maintenance depends on the facts of the case, including the parties’ circumstances, income, conduct and applicable law.
So this is not a blanket rule saying that wives can never receive maintenance or that maintenance automatically stops after a certain period.
