Q&A 📩: Who is behind this account?

One thing we’ve learned over the last few years is that people often see the ending of a story without knowing how it began.

Before the defects, the disputes, and the litigation, there was a family, a vacant lot, and a dream of building a home. 🏡

This is how it all started. 🌹….🥀

Apparently, choosing which wall the drain belongs on also makes you responsible for the plumbing rough-in.

Even when:

• Their plumber installed it
• We paid extra for it
• They sold us the drain

We had a construction loan. 🏦

So why were WE the ones making payments to the builder? 🤔

Fair question. And the answer is a little more complicated than you might think.

Let’s just say we never imagined building a house would involve quite so much time in the middle. 🙈💰

Or that the story would eventually lead to a courtroom. ⚖️

🎰✨ WELCOME TO LIEN OR NO LIEN! ✨🎰

Today’s contestant thought adding a casual $20,000 to a mechanic’s lien meant the court would just shave a little off the top.

❌ BZZZZT! WRONG ANSWER! ❌

Under New York Lien Law § 39, when a court finds a mechanic’s lien was WILLFULLY EXAGGERATED, the ENTIRE lien is void. Not just the inflated portion.

💸 $100,000 → $0!

BUT WAIT! THERE’S MORE! 🎉

Under § 39-a, in qualifying lien-enforcement proceedings, the lienor may also be liable for our fabulous bonus prize package:

🏆 The amount of the exaggeration!

🏆 The homeowner’s reasonable attorneys’ fees incurred securing discharge of the lien!

🏆 Bond premiums or qualifying discharge-interest costs!

🎓 Some lessons are expensive.

Play stupid games, win statutory prizes. 🏆💸

📢 PSA: NEW YORK MECHANIC’S LIEN LAW 101 ⚖️

You can add whatever you want to the cart at midnight. The statute still wakes up in the morning. 🛒🌙

🛠️ Construction labor? Sure.

🪵 Building materials? Absolutely.

📞 Phone calls? 📧 Emails? 🧾 Administrative charges?

Well, now we have some questions. 👀

Under New York Lien Law § 3, a mechanic’s lien secures qualifying labor and materials furnished for the improvement of real property. Not every charge that can be invoiced necessarily qualifies.

Turns out, “ADD TO CART” 🛒 and “ENTITLED TO LIEN” ⚖️ are two very different buttons.

And a contract doesn’t magically turn every billable item into a statutory lien right. 🪄

🎶 Oh, what a beautiful bill.

Apparently Zappico is a big fan of this page. 🥰

Some fans leave likes. Others file defamation lawsuits. 💌

We prefer receipts. 💋

Imagine the hardship of being asked to FINISH THE WORK before collecting the money.

Thoughts and prayers during this difficult time. 💋

“Substantially complete.”

Three bathrooms. Zero toilets. 🚽

Imagine telling us we were the first customers you had EVER filed a lien against.

Bold statement.

Especially when the receipts come with a notary stamp. 💀

Apparently “first” is less of a historical fact and more of a ✨vibe✨.

Memory fades.
Public records don’t. 💋
