It’s FAQ Friday! ⚖️ Does cheating mean one spouse automatically receives more of the marital assets? Not necessarily.

In Florida, the affair itself is generally not the focus. However, if marital funds were spent on gifts, travel, housing, or other expenses connected to an affair, the court may consider whether those funds were intentionally wasted or depleted when dividing the marital estate.

Every case depends on its specific facts, timing, and available evidence.

True or False: Both spouses must have independent legal counsel for a prenup.

AAML Florida Past President Laura Davis Smith explains that while the answer is technically false, it is not that simple. A prenuptial agreement can be created without attorneys, but doing so can create significant risks.

Having experienced counsel helps protect both parties and strengthens the integrity of the agreement from the outset.

At the 2026 Marital & Family Law Review Course, Charles Miller of Boies Schiller Flexner LLP revisited Levy v. Levy, a 2005 case involving a permanent injury after only two years and four months of marriage.

While exceptional circumstances supported permanent alimony under the law at that time, Florida’s current statute prohibits durational alimony for marriages lasting less than three years. Miller examines the difficult question this creates: where does that leave someone facing circumstances like Mrs. Levy’s today?

AAML Florida members came together for a memorable retreat filled with great conversations, incredible food, a little adventure—and plenty of time to simply enjoy being together.

From taking in the city and its beautiful fall weather to learning a few new skills in the kitchen, the weekend was a wonderful reminder that some of the best connections happen outside the courtroom.

Last week, AAML Florida was proud to be represented at the AAML Institute for Family Law Associates! (@aamlnational)

AAML Florida Past President Laura Davis Smith served on the faculty, presenting on drafting orders and preserving the record, attachment theory in custody determinations, and resist-refuse dynamics, alienation, and estrangement.

She was joined by AAML Florida Past President and current AAML National President Tom Sasser, who presented on building a strong professional reputation.
