I often think about the difference between someone like Elie Wiesel, who survived the Holocaust and carried unimaginable injustice with dignity, and how easily the rest of us can unravel over small inconveniences.

As you get older, especially with family, kids, and responsibility, almost everyone is dealing with something hard. Health scares. Work pressure. Broken relationships. Feeling misunderstood.

These images and clips always bring me back to perspective.

My dad was 36 with three kids and a wife when he was given a terminal prognosis with close to a zero percent chance of survival. I was five. Despite the odds, my dad asked the doctors one thing: show me someone who survived. He just wanted to know it was possible. And he did survive.

I realize now I do the same thing.

When I am struggling, I look for people who have been through real adversity and come out the other side. Sometimes that is my dad. Sometimes it is others. Not for guarantees, just proof that it can be done.

I have not always handled adversity well. I am still learning. A lot of growth is pausing, getting clear on what is in your control, and recognizing how much suffering comes from mindset, not circumstance.

When something tough would happen, my dad used to say, “This is the best thing that ever happened to you.” I believe that now.

Life is not meant to always be easy. We can do hard things. I try to pass that on to my kids, my people, and my clients. I also have to remind myself of that.

If you are ever going through a tough time, I am always here. We can do this. by @benjysmith

Stop using AI to draft what you send our firm (@thesmithlaw ) to decide whether to take your case.

Here’s why: “Anything you say can and will be used against you.” I learned that phrase watching Cops as a kid — long before Miranda rights as a lawyer. (Wildly inappropriate show for a kid, in hindsight. Apparently it shaped my career.)

Not criminal law (we represent employees against employers), but the same logic applies. I use AI all day, every day — just not for this.

1. Privilege may not apply yet. It protects what you tell us once we’re your lawyers — not what you type into a chatbot beforehand. That can be discoverable later.

2. It’s a red flag. AI-written intakes bury the point in unnecessary detail, use legal language a non-lawyer wouldn’t naturally use, and smooth out the small human details that help us tell a real case from a shaky one.

We’ll ask the questions that matter — often about something you wouldn’t think to mention.

We work on contingency and only get paid if we win, so we’re highly selective — we reject roughly 97% of people who come to us. A short, plain answer gives us the best shot at seeing what’s actually there.

Skip the AI. Tell us what happened, briefly, in your own words.

I want to be a resource for everybody, in whatever way I can.

Employees first, always. That’s who I represent and who I fight for. @thesmithlaw

But my employer friends matter too. I can’t represent you and I never will, but I can always point you in the right direction.

And beyond that, I’m known as a connector. I refer out a ton of business, plumbers, top attorneys in the country, everything in between. Part of it is just something I genuinely enjoy, no strings attached. But, it’s also brought a lot of value back into my life over the years. It’s one of those things where the more I give, the more it comes back around. So I keep doing it.
