Lenders can now clear title disputes faster in Ontario, here’s how it works for property sales. ⚖️

A recent Ontario Court of Appeal decision gives mortgage lenders the ability to remove certificates of pending litigation (CPLs) that block a power of sale, even if they aren’t part of the original lawsuit. Before this, lenders were stuck waiting for consent or court action to clear disputes off a property’s title, making commercial and luxury residential sales unpredictable and slow. 🏢

Now, courts can discharge a CPL if the lender’s claim is the highest priority and no one is disputing that claim. This closes a gap in the process, so legitimate lenders aren’t held up by third-party title claims.
