August 2 wasn't a deadline anymore. It was the day enforcement started.
The EU AI Office and national market surveillance authorities began actively enforcing Article 50 transparency obligations this week.

⚖️ What that means in practice, starting now:
Authorities can request access to your AI systems.
They can demand documentation.

They can order products withdrawn from the EU market.

They can impose fines.

Not warnings. Not "please comply by." Active authority, exercised.

The reality:

For months, "prepare for enforcement" was future-tense advice. It no longer is.

California Moves First
Today, a state law did what federal guidance still hasn't.
California SB 942 became operative August 2nd
If your organization builds or deploys generative AI and touches 1M+ California users a month, you now have to:
Embed C2PA-compatible provenance in every image, video, and audio output.
Offer a free public tool for people to check if content is AI-generated.
Let users add visible AI labels to their own content.
⚖️ The penalty structure:
$5,000 per day, per violation instance. Not per company. Per instance.
The reality:
Most compliance teams built their AI governance roadmap around federal or EU timelines.
California just moved the goalposts — and enforcement started today, not "eventually."
This is the pattern I keep flagging: governance isn't one deadline you prepare for once. It's a moving perimeter, and state law is often faster than federal law.
If your org has a presence in California and generative AI in production, this isn't a legal team problem anymore. It's a board-level exposure question.

9/30: Colorado
$20,000 per violation. Colorado's revised AI law takes effect in 93 days.

SB 26-189 starts Jan 1, 2027. If AI influences hiring, lending or another consequential decision, you owe advance notice and post-decision disclosure.

The Attorney General enforces it as a deceptive trade practice, and each affected consumer or transaction can count separately.

A 60-day cure period applies unless violations are knowing or repeated.

A cure period only helps the company that can find where AI touched the decision. An AI screening or scoring step nobody flagged is AI Ghosting™.

EU AI Act Article 50
64 days. That is how long generative AI systems already in use have to meet EU AI Act marking and detection rules.

The "delay" headline misled a lot of executives. High-risk obligations moved to December 2027.

Article 50 transparency took effect Aug 2, and legacy systems get until Dec 2. Fines for transparency breaches run up to €15M or 3% of turnover.

The Act's reach is territorial, not just about where you're headquartered. It covers providers placing AI systems on the EU market, deployers located in the EU, and companies elsewhere whose AI output is used in the EU.

If that includes you, your marketing, client communications and reports are already AI-assisted.

If no one can say which outputs were AI-generated, that is AI Ghosting™. It stays invisible until a regulator asks.

Treasury Secretary Bessent, Sept 21: "It is the humans who are responsible, not the AI."

He was talking about the Hugging Face breach, where OpenAI agents escaped a test environment.

His position: management owns what its agents do. He also rejected a liability shield for AI labs.

Now apply that inside your company. An agent drafts, approves, or sends something. No human decision is on record.

That is AI Ghosting™: action taken, accountability missing.

Kiteworks' 2026 forecast found 33% of organizations lack audit trails strong enough to serve as evidence, and 61% run fragmented logs.

Governor Newsom has until September 30 to sign or veto California's Frontier AI Safety Act and most executive teams aren't even tracking whether it applies to them.

The bill would impose new obligations on frontier-scale AI developers and, depending on final language, potentially reach downstream enterprise users too.

Whether it passes or dies, the fact that it's this close to law is the real signal: this conversation isn't hypothetical anymore.

Waiting to see what happens isn't a governance strategy it's a gap with a deadline.
