Decades of clicking agree, summed up by Heather Physioc, Chief Discoverability Officer at VML: “We’ll just sign over everything for terms and conditions.”

She wonders if AI gets the same deal. Last week the UK’s privacy regulator said ten AI developers, OpenAI and Google among them, made or committed to changes on how personal data trains their models.

Is vouching basically the next LinkedIn endorsement? That came up on our podcast with Heather Physioc, Chief Discoverability Officer at VML, and her answer, roughly:

anyone can say nice things about themselves
it counts when someone else will “stick their neck out on your behalf”
then the conversation gets to marketing accounts propped up by fake followers

Ad numbers work the same way. Last week Bitdefender reported malware on cheap Android phones tapping ads and filing conversion reports with nobody holding the phone.

This week the browser security company Island published research on a phishing campaign aimed at the people who run ads. The attackers built fake AI ad tools under names their targets already trust (ChatGPT, Claude, Gemini, Perplexity, and a “Muse Ads” that borrowed the name of Meta’s new AI eight days after Meta announced it), pitched them to media buyers and agency account admins as help with campaign planning, and gave each one a Connect button. Clicking it opens a fake login window inside the page that looks like a real Google sign in, and the password and security code go to the attackers.

Heather Physioc (@heatherphysioc), Chief Discoverability Officer at VML, was on our podcast talking about why borrowed credibility works in general: a polished answer, an impressive title or an institutional logo lowers our skepticism before we check what’s behind it. In her words, “It just creates this illusion of rigor even when the evidence is actually weak.” by @daypartai

On how junk sites end up next to legitimate stores: vibe code the site, fake a Reddit consensus, and "you can make things look so official so easily these days."

In this clip, Shoshana Wodinsky shares how one sports betting site tried to stop users from leaving.

When a cursor moved toward the corner of the screen, the site surfaced upcoming games based on that person’s betting history. If you bet on Brazil, you saw Brazil matches.

Google can write the product claim and send the ad into market. The advertiser is still the one answering for whatever it says.

Ad fraud can start before the click if the ad itself is making things up. by @daypartai

Audience data companies sell advertisers groups of devices categorized by traits or behaviors. In one example, a seller claimed about 80,000 mobile IDs were tied to pregnancy.

Privacy journalist Shoshana Wodinsky (@swodinksy) joined our podcast and explained how she investigated the claim. She followed it through the data supply chain and reached foot-traffic signals near retailers carrying children’s merchandise. The final segment name carried far more certainty than the source data.

Companies of every size have been getting CIPA demand letters over the pixels on their websites. California's SB 690 would take the pen register claim, one of the main theories behind those suits, away from private plaintiffs and leave it to the state Attorney General, with wiretap claims under Section 631 left alone. The governor has had it since September 4. No veto by September 30 and it takes effect January 1, pending suits filed in 2025 or later included.

When advertising and ecommerce lawyer Robert Freund came on Deeper Diligence, he got into how something a brand does while it's small can still be exposure after it grows.

Our latest podcast guest, Shoshana Wodinsky, walked us through one of the ugliest examples of what commercially available ad-tech data can do. A priest’s supposedly anonymous app data was used to figure out where he lived, which bars he visited and who he was, eventually costing him his job.

Steven Liss says if you ask ChatGPT what he likes for dinner, you probably will not get an ad about his Diet Coke habit. A question about getting a job at OpenAds and how to make a good impression might pull one.

AdExchanger surveyed answer engine optimization practitioners yesterday on the tactics that stopped working. Promptwatch had Reddit's share of ChatGPT citations at 3.83% from July 18 to August 7, then 0.52% across August 14 to 17.
He also has a link on his site that only agents can see, for booking a meeting with him.

"That's how stalking happens."

@swodinsky ten seconds into the new episode, on why precise location gets special treatment in state privacy laws. Then the rest of it on what got built instead: QR codes at the table, wifi logins that want an email.

Meanwhile four DoD components turned off the mobile ad ID and location data from their facilities keeps selling.

Two payment processors in six days. Nuvei on September 4 for $4.85 million. Humboldt yesterday for $12 million plus a permanent ban on high risk merchant categories.

We asked Robert Freund whether the enforcement picture looks the way most people assume it does.
