Under Louisiana law, generally, a person is eligible for an expungement after five years have passed since completing their sentence for misdemeanors and ten years for felonies. However, if you plead pursuant to Code of Criminal Procedure articles 894 or 893, once you successfully complete your probation requirements and court orders, you can file a motion with the court to dismiss the charge and request the expungement of your record. Not all charges qualify for expungement, particularly violent offenses.

Additionally, you cannot have any new convictions during the five or ten waiting periods; it resets the clock. Furthermore, you cannot have any new charges pending if you pleaded guilty under articles 893 or 894. #neworleans taken in New Orleans, Louisiana by @djuanmansfield

If you’re out on bond after being arrested do these three things:
1. Gather any and all evidence as soon as possible that may assist in your defense.
2. Honor whatever stay away order the court puts in place.
3. Stay positive, and try your hardest not to pick up any new charges.
