Healthcare has already learned, through cases like Larry Nassar, the catastrophic consequences of institutions failing to take warning signs seriously. I’m not comparing these two men’s criminal histories - Newell has not been convicted of a crime. I’m saying patient safety requires institutions to take concerning conduct seriously before handing someone extraordinary access to vulnerable patients.

This is not about ruining a man’s reputation. It’s about protecting our patients and recognizing the immense responsibility that comes with being entrusted with another person’s body at their most vulnerable. And that is exactly why I don’t think we should shy away from conversations like these.

We can respect due process while still demanding that patient safety remain our highest priority.

🏥 On The Pitt, ICE agents walk a zip-tied patient into the ER. The nurse who tries to protect her is slammed to the floor and dragged out.

That was fiction in March. Real life followed. In Michigan, nurse Chloe Freeman, 33, is now charged with helping an injured ICE detainee walk out of an Ann Arbor ER. Prosecutors say she told investigators she believed he could have died. She has pleaded not guilty.

Years earlier, hand surgeon Dr. Erin Nance faced her own version of that choice. “This is a dangerous post, but I’m going to post it anyway,” she says in this video.

As a doctor in training, she met a construction worker in the ER after an eight-story fall, his hand nearly amputated. He refused to give his name or let her operate, and ran. The next morning, at the construction site, she learned why: he was undocumented and terrified of being deported.

“I am a doctor. I’m not a lawyer,” she says. With the help of a very brave attending, she found him, and they operated on him as a John Doe.

That fear is everywhere now. 48% of likely undocumented immigrants say they or a family member avoided medical care in 2025 over immigration concerns. In January 2025, DHS ended the policy that treated hospitals as protected areas.

What everyone should know:
✅ Under EMTALA, a federal law since 1986, Medicare hospitals must screen and stabilize anyone with an emergency, regardless of ability to pay.
✅ CMS does not require hospital staff to ask about immigration status.
✅ Agents generally need a judge-signed warrant or consent to search exam rooms and other private areas.
