Section 3, Prevention of Insults to National Honour Act, 1971 is the clearest provision. It covers anyone who intentionally prevents the singing of the Indian National Anthem or causes disturbance to an assembly engaged in singing it. Punishment can extend to 3 years’ imprisonment, a fine, or both.

Also:

BNSS Section 46 says an arrested person must not be subjected to more restraint than necessary to prevent escape. For the arrest of women, BNSS Section 43 also places particular restrictions on physical touching by male police officers, subject to the statutory exceptions. Depending on the evidence, provisions concerning hurt, criminal force, wrongful restraint, or BNS Section 198, which deals with a public servant knowingly disobeying the law with intent or knowledge of causing injury, could also become relevant.

There is also a constitutional dimension. The Supreme Court has expressly recognised peaceful protest under Articles 19(1)(a) and 19(1)(b), while acknowledging that lawful and reasonable public-order restrictions can be imposed. Crucially, it has said that authorities exercising those powers must remain within the limits of law and cannot indulge in excesses.
