Trump's Department of Justice intervened in our lawsuit against xAI and argued that it has the authority to shut down citizen suits, which allow impacted communities to file lawsuits against polluters for violating the law. This is an attempt to strip power away from local communities, the courts, and Congress and consolidate power within the Trump administration.

"It's remarkable for the United States to intervene on behalf of a polluter in a case like this," said Laura Thoms, the Director of Enforcement at Earthjustice, which represents the NAACP along with the Southern Environmental Law Center. "Ordinarily, they would intervene to enforce the law."

BREAKING: We're suing Elon Musk’s company, xAI, for building an illegal power plant in Mississippi to fuel its data center – with no air permits and little protection for the people living around it.

xAI built a data center in Memphis to train the Grok chatbot. In the nearby town of Southaven, Mississippi, xAI is running 27 gas turbines that pump out air pollution around the clock. Gas turbines release smog-forming pollution and hazardous chemicals like formaldehyde, which has been linked to cancer. This illegal gas plant is spewing this toxic pollution just a mile away from an elementary school, and even closer to nearby homes.

There are no exceptions that would allow this major source of pollution to evade the law. We're partnering with the Southern Environmental Law Center to represent the NAACP and fight for clean air for the people of Southaven. by @earthjustice

A week after cutting habitat protections for endangered species across the country, the Trump administration finalized two more rules to weaken the Endangered Species Act (ESA) even more.

One rule strips automatic ESA protections from newly listed threatened wildlife, leaving them vulnerable to killing and trapping. The other puts "economic interests" ahead of science, giving industry greater influence over whether critical habitat is protected or destroyed. Together, these rollbacks put endangered wildlife at greater risk of extinction.

“This prioritization of industry interests over science is fundamentally at odds with the clear purpose of the Endangered Species Act. We won’t let this dangerous giveaway go unchallenged,” says Earthjustice senior attorney Elizabeth Forsyth. by @earthjustice
