Rebecca had been running her design business on contracts she'd "cobbled together from various free templates".

I see this all the time. A payment clause from one site, an IP section from another, a website policy written for someone else's business. It holds together right up until a client pushes back.

So Rebecca swapped the patchwork for one kit built for graphic designers. She watched the video, learned what each clause actually does, and made it hers.

Her words: "I feel so much better knowing I'm properly covered."

That feeling is the whole point. Comment PROTECT and I'll send you my free Business Startup Checklist, so you can spot what's missing from yours.

"We've decided to go in a different direction." Eight words every designer has read, usually after the finals went out.

You've done the work. They've got the files. And now the final invoice is "being looked at". It's one of the most common messages I get from designers, and it almost always traces back to the same few gaps in the contract.

New on the blog: Graphic designer contracts in Australia, 7 clauses that will save your business. IP, usage rights, revision limits, kill fees, milestones, portfolio rights and what to do when it all goes sideways.

Read it before your next proposal. Link in bio. Want the free Business Startup Checklist too? Comment PROTECT.

You sent the final files on a Friday. Logo, colour palette, brand guidelines, the lot.

On Monday the client emails to say they're "pausing the project". The last invoice is "on hold".

By Wednesday, your logo is on their website.

Here's the twist most designers don't know. Until copyright is assigned in writing, the design usually still belongs to the person who created it. That's you. A paid invoice isn't an assignment. Neither is a "love it!" email.

The lower risk way is simple. Ownership passes when the final invoice is paid, or the client gets a licence and you keep the rights. Either way, it's written down before you start, along with your portfolio rights.

Swipe through, then comment PROTECT for my free Business Startup Checklist. Designers, tag the friend who's still sending finals before the final invoice. Want the full picture? Nobody gets excited about a Word document. I know. But stay with me.

When you buy a Foundd template, you're not buying a download. You're buying the bit you don't see: a lawyer (me) drafting it for Australian law, then rewriting it until a non-lawyer can read it without a dictionary. That second part takes longer than the first.

Every template has guide notes that explain what each clause does, and yellow highlights where your details go. Fill them in and you're done. No decoding, no guessing.

Comment PROTECT and I'll send you my free Business Startup Checklist. It'll show you which ones you need first.

The message usually arrives late at night.

"Quick question. Do I really need a contract for a $500 retainer?"

I get it. The client is lovely. The work is small. Sending a contract feels like turning up to a picnic in a suit.

Then three months later, the hours have tripled without the fee moving, two invoices are overdue, and the client has started messaging your subcontractor directly.

Small retainers aren't small when they go wrong. They're just too small to be worth a lawyer, which makes them the most frustrating kind of problem to have.

These are the five questions I hear most from VAs and OBMs, answered short and sweet. Save it for your next discovery call.

VEE thought her service agreement had her covered.

Then she worked through one written for VAs and OBMs and found something she'd never thought about. IP. As in, who owns what you create for your clients.

Her words: it "really up levelled my service". Nothing had gone wrong. She just started every client relationship knowing her agreement supported her client and herself.

That's the bit people miss. Contracts aren't only for when things go sideways. They change how you show up.

Today I'm teaching Contracts and IP to a room full of VAs, so VEE's story felt right. Comment PROTECT and I'll send you my free Business Startup Checklist.

Signing your client's contract feels polite. It's also the fastest way to work under terms written for somebody else.

I get why it happens. The client is lovely, they've already got a contract, and asking to use yours feels a bit much when you've only just met. So you sign theirs and get started.

The catch is that their contract was written to protect them. It usually says nothing about the SOPs you build, how fast they pay you, or what happens when they "borrow" your subcontractor.

New on the blog: Virtual assistant contracts in Australia, what every VA and OBM needs before working with a client. The eight clauses, the contractor vs employee question, and the two FAQs I get every single week.

Grab a cuppa, it's a proper read. Link in bio. Want the free Business Startup Checklist too? Comment PROTECT.

You're great at running other people's businesses. Yours deserves the same treatment.

Most VAs and OBMs I talk to start a new client on a friendly Zoom and a "sounds great, let's go". Then the hours creep. The SOP library you built becomes "ours". An invoice sits for 45 days while you keep answering Slack.

None of that is a people problem. It's a paperwork problem. Scope, IP, late payment, notice and how the relationship actually works day to day. Five things, written down once, before you touch a single password.

The ticks feel good. I get it.

Business name registered. Domain bought. Handle claimed before anyone else got it. That's a solid first week, and none of it is wasted.

It just isn't protection. Those three tell the world you exist. They don't give you the right to stop someone else using the same name for the same thing.

That's what a registered trade mark does, and it's the step most people leave for "later". Sometimes later arrives as a letter. Not one you sent.

Comment PROTECT and I'll DM you the Business Startup Checklist, so you can see exactly what's missing.

It was a Tuesday when the email came through.

A brand new business. A name almost identical to yours. Same industry. A logo that looked a little too familiar.

You did everything right, or so you thought. ABN in week one. Business name registered with ASIC. The .com.au snapped up. The handle claimed before anyone else could get it.

So you start working out what you can actually do about it. And one by one, those registrations fall away. The ABN is a tax number. The business name is a listing. The domain and the handle are rentals, with someone else's rules attached.

The one thing that would have given you exclusive rights to the name for what you sell is a registered trade mark. It's also the one most people leave until after that email arrives.

Don't wait for your Tuesday. Comment PROTECT and I'll send you my free Business Startup Checklist. All five, in the order you need them.
