It’s hard to believe, but last week was the first #hof for 2026! With the London Book Fair just weeks away, and Bologna not too far behind, it was good to gather virtually with book #publishing professionals around the globe and talk about trends in the industry. Last week’s session focused on trends in editing, with the use of #AI dominating a lot of the chat. Can’t wait for the next session and get more inspiration ahead of this year’s Frankfurt Book Fair! #fbm #frankfurtbuchmesse by @gryphpub

In a surprising turn of events, Anthropic has reached a preliminary settlement agreement with authors and publishers in the Bartz v. Anthropic case. Earlier this month, although Judge Alsop ruled that the use of authors’ materials to train the Claude LLM was fair use, training the LLM on materials obtained from pirated sites was not. We encourage all of our author and publisher friends to stay informed and receive notice, you may register at: https://www.lieffcabraser.com/anthropic-author-contact/?mc_cid=cb92e50f93&mc_eid=40436aa52c by September 1, 2025

We're pleased to share that MJ has been tapped to join the Executive Committee and serve as the next Board Secretary for the Independent Book Publishers Association (IBPA) for the term beginning July 1. She says: "I am honored to deepen my service to members and the independent publishing community at large, and I thank board chair, Tieshena Davis, for trusting me with this responsibility." Way to go, MJ! https://www.ibpa-online.org/page/board #board #boardservice #publishing #publishinglife #ibpa by @gryphpub

Grateful for another successful IBPA Publishing University! It was a whirlwind of conversations, amazing panels, lots of talk about copyrights, AI, and of course making new friends and re-connecting with publishing colleagues! I'm looking forward to putting some of what we learned into action at GPC as well as following up with our new friends! #publishing #pubu2025 #ibpa #independentpublishing #publishersconference #copyright #ai #aiandpublishing #boardmember @ibpalovesindies @mjslazak My ridiculous ribbon collection. by @gryphpub

Last week, the U.S. Copyright Office released the pre-publication third part of its study on copyright and AI. The third installment takes a look specifically at generative AI, and how the acquisition of materials used to train these models intersects with current copyright law in the U.S. You can find all three sections of the report here: https://www.copyright.gov/ai/

Of note, this third report states: "...The Copyright Act grants copyright owners a set of exclusive rights: to reproduce, distribute, publicly perform, and publicly display their works, as well as the right to prepare derivative works. Establishing a prima facie case of infringement requires two elements: "(1) ownership of a valid copyright, and (2) copying of constituent elements of the work that are original.” Creating and deploying a generative AI system using copyright-protected material involves multiple acts that, absent a license or other defense, may infringe one or more rights."

Some AI companies have legitimately licensed content for use in training LLMs (see Created by Humans), and license language has been crafted to address AI training by both large publishers and agents (see Harper Collins and The Authors Guild). Clearly, content has value, and as such, creators should be compensated for their work if it is used in ANY commercially-derivative manner, including training AI.

Disturbingly, shortly after the report was released, the current Registrar of Copyrights and Director of the U.S. Copyright Office was dismissed. It's important to note that this position is not appointed by the White House (though this office is under the Librarian of Congress, which is a political appointment). Whether this will affect the release of the final report or not is unclear. But protecting the intellectual property of creators is not something to be politically weaponized. #copyright #ai #aitraining #publishing #uscopyrightoffice #llm #largelanguagemodels by @gryphpub

It should not be controversial to state that it's urgent we all work to maintain #freespeech in all of its forms here in the US. We need to continue the work to to protect academic freedom, freedom of the press, promote diverse publishing programs, keep libraries open, and allow all children to see themselves in books.

Read about the Pen America report on the first 100 days of the new administration here:
