#WBW2026 - Promoting and supporting breastfeeding is not enough. Legal protection must also be put into practice.

The International Code and subsequent World Health Assembly resolutions set limits and regulations at country level on the commercial promotion of products within the scope of the Code and help to protect breastfeeding from inappropriate and abusive marketing practices.

Understanding these standards, demanding compliance , reporting and monitoring breaches of the law : these are practical ways to strengthen what works.

When breastfeeding promotion and support include legal protection against the marketing of breast-milk substitutes - breastfeeding is strengthened.

#WBW2026 – Breastfeeding for a sustainable start in life: strengthen what works

Breastfeeding support begins at birth, but it must continue following discharge. Trained teams in the maternity unit, implementation of the Ten Steps, compliance with the International Code, follow-up through health services, support networks, paid leave and suitable workplace conditions all make a difference.

Strengthening what works means bringing together care, protection and support so that mothers and babies have the conditions they need to start and continue breastfeeding.

Have you realised how you too can strengthen what works? Help ensure that effective actions are put into practice!

The 49th Codex Alimentarius Commission (#CAC49) will meet in Geneva next week to decide whether new guidelines and standards are ready for final adoption. Of concern to IBFAN and partner health advocates are new Guidelines, proposed by the United States, that will allow ‘Competent Authorities’ to grant ‘flexibility’ to food companies when labelling products for emergency situations.

During emergencies child deaths can be two to 70 times higher than the average rate. The risks of not breastfeeding during the first six months are greatly increased when water and sanitation are scarce and basic hygiene breaks down. While all mothers have the right to decide how to feed their children, the uncontrolled donation and distribution of formula becomes a lethal risk – made worse if labels are idealised and warnings are missing, in the wrong language or unreadable. This is why full implementation of the marketing recommendations of the World Health Assembly, the International Code and subsequent WHA Resolutions are essential. The USA, a country that has failed to implement these recommendations and has now officially left WHO, dominated the labelling discussions, ensuring that the Guidelines completely fail to make any reference these essential safeguards.

IBFAN, ENCA, @ilcaworldwide, and WPHNA will be attending (in person and remotely) calling for the Guidelines to be returned to CCFL for further work to ensure that formulas and foods for infants and young children are EXCLUDED and the Code of Ethics for International Trade in Food (CXC 20-1979) INCLUDED.

This week we celebrate 45 years of the International Code of Marketing of Breast-milk Substitutes. Adopted on 21 May 1981 at the World Health Assembly, the Code exists for one reason: to protect babies and mothers from the commercial pressure of the infant formula industry. It prohibits the promotion of breast-milk substitutes, bans the sponsorship of health services by these companies, and makes clear that the interests of the child cannot coexist with the interests of the market.

45 years on, this principle needs to be restated — because it continues to be violated.

In the video, Marina Rea, IBFAN Brazil Coordinator, raises a concrete and urgent warning: Eurofarma, a pharmaceutical company that sponsors a human milk bank in Itapevi (SP), has become the preferred distributor of Danone/Nutricia products in Mexico — infant formulae and other products that compete directly with breastfeeding and with human milk.

A human milk bank is a Brazilian public asset. It cannot be associated — directly or indirectly — with companies that have commercial interests in products that substitute breast milk. This is not an opinion. This is a Conflict of Interest.

The warning is directed especially at the health surveillance authorities of the State of São Paulo, who approved the regulation of this human milk bank.

The Code is 45 years old. Vigilance cannot weaken.

At WHA79, IBFAN was once again in Geneva. Check out our statement on Item 13.1 Report of the Independent Oversight and Advisory Committee for the WHO Health Emergencies Programme:

As a member of the Inter-agency Infant Feeding in Emergencies Core group, IBFAN is very concerned about new Codex guidelines that will allow flexibility for labelling, including of baby formulas and foods, during emergencies.

The onus will be on Member States to stop exploitation by those seeking to undermine breastfeeding and expand markets. There is evidence that few Member States have effective emergency preparedness plans, so they lack the capacity to recognise deceptive labelling. During COVID, formulas claimed to provide 'immunity.' During floods, that they aid 'recovery.' Any deregulation risks the health and survival of displaced families, while undermining tracking of contaminated products. While ALL women have the sovereign right to make infant feeding decisions, complete and accurate labelling is essential, especially in emergency situations. It's time for Member States to ensure this.

At WHA79, IBFAN was once again in Geneva. Check out our statement on Item 12.4 Universal health coverage:

IBFAN strongly supports the right to access to free and adequate health care. To be effective, strong conflicts of interest safeguards are needed to prevent harmful industry practices that negatively impact health.

Prevention for optimal health is critical and starts with infant and young child feeding, breastfeeding, and avoidance of ultra-processed products. Companies process raw ingredients to achieve sweetness while claiming products are healthy. Sweetness is addictive and sets up taste preferences in children, programming them to consume sweet ultra-processed products.

The intentional higher levels of added sugar content by companies targeting the Global South is an unethical and unacceptable double standard.

IBFAN urges governments to fully implement the Code, now 45 years old, and to enact strong legislation covering all products marketed for infants and children.

At WHA79, IBFAN was once again in Geneva. Check out our statement on Agenda Item 15.4 - Maternal, Infant and Young Child Nutrition:

A new threat to infant health is disaster capitalism.

Firstly, the intrinsic contamination of formula, a child's first ultra-processed food, has led to legal actions on infant deaths and illness. A single contaminated ingredient was distributed to 130 countries, causing unprecedented recalls. Poor surveillance, lack of transparency, fraud, and poor crisis management have eroded public trust in the current food system, dependent on a handful of corporations.

Secondly, Codex Alimentarius may soon allow weaker labelling of food products in emergencies. This opens the door to commercial exploitation, double standards, and unethical dumping of products globally.

Member States should please send health delegates to Codex who can ensure that products for babies are excluded from this proposal.

The 2026 WHO Code Status Report is out - and the data speaks for itself.

Drawing on standardised analysis of legal frameworks from 194 countries, this report maps how far (and how far still to go) national implementation of the International Code of Marketing of Breast-milk Substitutes has come.

The findings are clear: where legal alignment with the Code is stronger, rates of exclusive and continued breastfeeding are higher. Yet persistent regulatory gaps remain - in promotion, labelling, health system safeguards, and monitoring and enforcement.

Produced by @who , @unicef and IBFAN, this report is essential reading for policy-makers, health advocates and all those working to protect families from predatory marketing.
