No single federal authority governs healthcare AI completely and the gaps between them are where patients are most at risk.

The FDA clears AI tools as medical devices but until early 2026 lacked any mandatory post-deployment surveillance requirement. The recently finalized PCCP framework allows manufacturers to pre-authorize future AI modifications. However, participation is voluntary and it does not require ongoing performance monitoring across diverse patient populations after deployment. HIPAA protects data privacy but says nothing about algorithmic fairness. HHS oversees healthcare broadly but has no specific AI enforcement mechanism. The FTC can act but only after harm has already occurred.
States like California, Colorado, Illinois, and Maryland stepped in to fill the gap. Then a December 2025 Executive Order directed the DOJ to legally challenge state AI laws deemed too strict.

Before December 2025: A confusing patchwork of rules.

After December 2025: A federal government dismantling that patchwork without a replacement.

We haven’t just simplified compliance. We’ve removed the safety net.
