What is the difference between public and community housing?

As Homes Victoria continues to prepare to demolish the North Melbourne and Flemington public housing towers and relocate the people living there, we know that residents have many questions.

There is confusion because many residents are being relocated into community housing; and the government has announced that there will be no public housing on the rebuilt estates in North Melbourne and Flemington, only community housing.

It is important to understand there are different rights and protections between public and community housing. #savethetowers by @innermelbcl

Earlier this year, the High Court of Australia agreed to hear an appeal in the class action against the demolition of Victoria’s Public Housing towers. We now have a date for the hearing: 7 OCTOBER.

IMCL is supporting residents to take Homes Victoria to court.

Since the beginning of the trial in October 2024, we have been arguing that the rights of residents weren’t properly considered, and that they should have a say about whether the towers will be demolished or not.

The case in the High Court will continue to argue that public housing residents should have been consulted with before a decision was made that affects them and their communities. by @innermelbcl

It was great to have the opportunity to talk about the Social Housing Legal Program at the Australian Homelessness Conference in Darwin last week.

The program is a joint initiative by West Heidelberg Community Legal and Inner Melbourne Community Legal to address gaps in legal knowledge and services for people living in community housing.

Stephanie Price from the SHLP spoke at the conference about how the increased reliance on community housing by governments in Victoria to fill the gaps left by decades of underinvestment in public housing raises critical questions about renters’ rights, security, and the long-term social cost to the Victorian community.

She drew on casework from the program and a research report which has analysed cases before VCAT over five years to examine legal issues including procedural fairness, transparency in decision-making, and barriers to challenging housing provider actions.

Stephanie is pictured second from right with fellow panelists Vee Blackwood from Homelessness NSW and Natalie Bradshaw from Legal Aid NSW along with facilitator Sharon Collinge from Fair Trading NSW.

The work of the SHLP is enabled by a grant from the Victorian Legal Services Board grants program. by @innermelbcl

The fight by a Melbourne public housing community to prevent their homes being demolished will go all the way to the High Court of Australia today.

The full High Court will hear an appeal by Inner Melbourne Community Legal against a Victorian court’s decision which has paved the way for the demolition and redevelopment of all 44 public housing towers in Melbourne.

The High Court hearing is the final stage in a three-year legal battle by residents of the first three towers to be demolished in North Melbourne and Flemington.

Lawyers for the residents will argue that last year’s ruling by the Victorian Supreme Court of Appeal to allow the redevelopment program to go ahead should be set aside because tenants living in the towers were denied procedural fairness when the decision to demolish the buildings was announced. by @innermelbcl

We are saddened to report that Jason Mallard, who lived at 120 Racecourse Road for more than 25 years, recently passed away. He was 56.

Jason was the lead plaintiff in the appeal to the Victorian Court of Appeal last year against the demolition of his home by the state government. Earlier this year, he reluctantly accepted an offer to relocate to another suburb, but died not long afterwards.

Jason's bravery and tenacity to fight for the rights of himself and other public housing residents will be long remembered as we prepare for the final appeal in the High Court hearing next week. by @innermelbcl

Prison time still isn’t fine – while we are closer to a fairer fines system, the government missed an opportunity to remove jail time as a penalty for not paying a fine.

We call on all political parties to commit to removing prison as a penalty for unpaid fines – make sure you ask your local MP and candidates for the state election about what they plan to do to right this wrong.

Thank you to the Attorney-General @sonyakilkennymp for her commitment towards these wins – which builds on many fine reforms also achieved by former A-G @jaclynsymesmp.

Thank you to the @davidettershankmp and @rachelpayne_mp from @legalisecannabisvic for raising questions and tirelessly fighting for amendments in Parliament.

Thank you to the cross-bench for their support: @katherinecopseygreens from @victoriangreens and @georgie.purcell.ajp from @animaljusticepartyvic and @davidlimbrickmp from @libertariansvic. by @innermelbcl

Inner Melbourne Community Legal is saddened by the death of Brunswick MP Tim Read from cancer at the age of 64.

We had many dealings with Tim over the years, especially during his time as chair of the Joint Parliamentary Integrity and Oversight Committee (PIOC).

In addition to being a strong supporter of the community legal sector, he always listened respectfully to our concerns and engaged intelligently on issues.

During COVID he work closely with us to improve the fines system - pushing for concession-based fines for COVID breaches, and wider reform to make the fines system fairer.

We particularly appreciated the efforts he and the PIOC made to include our recommendations to improve the police oversight functions of the Independent Broad-based Anti-corruption Commission in a report that was tabled late last year.

The state government could honour Tim’s legacy in no better way than by implementing these recommendations in full. by @innermelbcl
