Dear Upcoming / Emerging Artists

When a label shows interest, it feels like validation, and that emotional high can push you to sign quickly. But most unfavorable deals are signed in moments like that, not out of strategy. Remember: a record deal is a business contract, not a reward.

Here are the real hazards to watch for:

1. Loss of ownership (masters)
You may give up full control of your music. That means the label owns your work and profits from it long-term—even after the hype fades.

2. Recoupment traps
That “advance” isn’t free money. The label recovers every cost (marketing, videos, studio time) before you see profit. Many artists stay unpaid for years.

3. Long-term lock-ins
Some contracts tie you down for multiple albums or years, limiting your freedom to evolve or leave if things go wrong.

4. 360 clauses
Labels may take a percentage from everything—shows, endorsements, merch—not just your music.

5. Creative control
You might lose the ability to decide your sound, image, or release strategy.

⸻

Smart approach moving forward:
• Slow down the moment — no deal is so urgent that it can’t be reviewed
• Hire an entertainment lawyer — not a general lawyer, but someone who understands music contracts
• Understand every clause — if you can’t explain it, don’t sign it
• Negotiate — terms are rarely fixed, especially if you have leverage
• Consider independence first — build your value before giving away percentages

Summary

A good deal should accelerate your career, not control it.
If it doesn’t protect your ownership, income, and freedom, it’s not an opportunity—it’s a liability.
