This week, we revisit the Temujin Kensu/Fred Freeman case with guest, @jduffyrice . How do we perceive guilt and innocence, particularly in cases where the evidence is questionable?

Josie 6 is 6! The queen of poses. An entertainer. A constant marvel. Cooler, funnier, smarter and more brave every day. Full of questions. Excited about everything. Loves her brother above all. I’d bet on her to change the world. How did we ever exist without her? Happy birthday Rami girl! Noodle, we adore you. by @jduffyrice

What is the difference between an innocent man and a good man? How do we think about guilt? I made a new show called The Backfire Effect, and it tries to answer some of these questions. It’s out today from Pushkin. First two episodes are up on all the podcast platforms. Link is in my bio etc etc

It’s about a man named Temujin Kensu, who was convicted of murder in Port Huron, Michigan, in 1987. He’s been in prison ever since.

The case started when a young man named Scott was shot in a college parking lot in broad daylight. Scott was the son of the local mayor. He’d been captain of the basketball team and voted Most Popular in high school, he’d just gotten engaged, and his fiancée was pregnant. Temujin had briefly dated her months earlier, which is why he was questioned for the murder. The problem was that he was 450 miles away when it happened. At least ten people saw him there.

That should have been the end of it. Instead, when prosecutors couldn’t explain how he was in two places at once, they introduced a witness who told the jury he could have chartered a plane in the middle of the night — with no pilot, no flight record, and no way for an unemployed man to pay for it. The story also includes a hypnotism, an invented international ninja organization, a jailhouse informant, a defense attorney with a crack-cocaine addiction, and a lead detective who made up police reports.

I don’t usually do innocence stories. This one took thousands of hours, a lot of time in Michigan, and more off-the-record calls than I’ve taken in the rest of my career combined. Temujin is smart, stubborn, talkative and extremely frustrating. He is not an easy man. Many people don’t think he’s a good man. There are people, mostly women, he treated horribly. I think the case for his innocence is probably the simplest part of this whole thing. The rest of it is much more complicated.

Please listen, give it a review, and tell your friends. by @jduffyrice

He had an alibi. Police didn't care.

Nearly 40 years ago, Scott Macklem was killed in broad daylight in a Michigan parking lot. The man police arrested said he was nowhere near the scene... and he could prove it.

In Examined: The Backfire Effect, journalist @jduffyrice talks with eyewitnesses, investigators and local reporters to unravel a shocking story of judicial apathy and expedience. A story that leaves no one off the hook. Listen now wherever you get your podcasts 🎧

Josie Duffy Rice is the fifth Josie in her family. Her daughter is the sixth. And in between carrying a legacy name, she covers prosecutors, prisons, and the many (complicated) layers of the criminal justice system, with bylines in The New York Times, Vanity Fair, and The New Yorker, and Peabody-nominated podcasts to her name. In our latest #GettingSticky, the podcast host and mom of two talks life in Atlanta, the obligation of history, and how becoming a mother reshaped her journalism practice.

This child is laugh out loud funny. Loving and brilliant. Rakish and rock ribbed. Every day is “awesome” or “the best day in the world!” Wildly imaginative - long after bedtime you can hear her in her room creating dramatic scenarios with her stuffed animals. She belts out every song in the car. She has a knack for impressions, loves to try new foods, and would follow her brother to the ends of the earth. She is a marvel, and if she so pleases will change the world. Time is a thief, and yet the years have been so generous to us. A distinct pleasure to watch this child we love so infinitely grow up. Happy 5th birthday Rami noodle! You complete us. by @jduffyrice
