“Can we boost your posts?” sounds harmless. It’s not. What they’re asking is whitelisting, and it’s one of the most misunderstood services in the creator economy. Whitelisting is a legitimate service that deserves its own fee, its own clause and set of limits. Swipe to understand what you’re agreeing to and how to charge for it. taken in London, United Kingdom by @legallens.consulting

US creators:
the FTC rules apply to you.
The FTC requires influencers to disclose any material connections they have with brands they promote, including receiving payment or free products, or being a brand employee or ambassador. The disclosure must be ‘clear and conspicuous’./The FTC has approved certain disclosure language and flagged others as insufficient. #Ad is the gold standard, clear and unambiguous. #Sponsored and Advertisement are also acceptable, but vague labels like #collab, #partner, #gifted, etc. are not sufficient on their own./The FTC warns against hiding disclosures behind ‘more’ buttons or long captions. On TikTok and Instagram Reels, the disclosure should appear in the video itself, not just the caption. For YouTube, it should appear at the beginning of the video. For Stories, it should appear on each frame where the brand or product is featured./This means every post, Story, video, or caption where the affiliate link or code appears needs its own disclosure. A link in your bio or a pinned highlight does not cover individual pieces of content./We help US-based influencers and creators:
Review and negotiate brand contracts
Advise on FTC disclosure compliance
Draft tailored influencer agreements
Chase non-payment from brands

In influencer marketing, reputational risks are real and immediate. But ending a creator contract is not automatic. Whether a brand can terminate depends on what the agreement says, what the scandal involves, and whether the influencer has actually breached their obligations./A morality clause is designed to protect reputation. It may allow a brand to end a campaign if the influencer’s conduct damages the influencer’s reputation, the brand’s reputation, or the commercial value of the campaign./If the influencer contract contains no morality clause, the brand cannot terminate simply because it dislikes the influencer’s behaviour. Instead, the brand would need to rely on common law or statutory grounds for contract termination./Morality clauses only cover what they say. The scandal must fall within the scope of the clause, the brand must act reasonably, and termination should be proportionate. Rumours or unsubstantiated allegations may not be enough./Brands need evidence, context, and a carefully drafted contract. Influencers should not accept one-sided terms without understanding the consequences, especially where payment, content removal, and future partnerships are affected. taken in London, United Kingdom by @legallens.consulting

With constant changes in AI disclosures, creators face risks when audiences aren’t clear on who is speaking in a post, whether it was influencer-approved or whether the post is synthetic.

The new AI disclosure rules established in 2025 have an impact on platform polices, advertising rules and consent rights. Brands and creators must disclose whether AI was involved if audiences reasonably assume the influencer recorded a post.

The strictness of these disclosures has increased, and hidden captions or links no longer cut it. Using clear, simple and prominent disclosures helps protect your creators. AI isn’t the threat; confusion is.

Think your content is automatically safe? Think again. 🔐

Yes, copyright protection exists under UK law… but the wrong contract can quietly hand over your ownership without you even noticing. ⚠️

Before you sign anything:
✔️ Know your rights
✔️ Keep control of your work
✔️ Avoid expensive disputes later

Smart creators don’t just create - they protect. 🧠✨

📩 DM LegalLens for a quick contract check before your next brand deal.
