![Negotiating contracts can be very daunting but once you get stuck in, it gets easier the more you do.
Keeping it brief on my chosen myths.
1. Some of the nicest lawyers I have met on contract calls, came across bullish on email! [Sometimes] it is hard to sense tone in writing, if you’re staring point is that they’re being friendly, you’ll enjoy the process more.
1.2 there’s no winner or loser in the traditional sense. If you’ve managed to get your clients main desires in the contract, you’ve won and both parties can win in contract negotiation.
2. Each party will have their dealbreakers in mind and these won’t always be clear at first. Always be bold enough to push back if something isn’t quite right for you/your client.
3. Some things will definitely be urgent. Most things, are not. Don’t panic, manage your work list by prioritising. Ask if you’re not sure.
4. Side letters, deeds of variation, addendums! I’m sure there are more and they all exist to effect changes to the original agreement. Just need to negotiate the changes LOL.
5. You may have heard this many times. It sometimes is the case for major corporations contracting with smaller entities or individual service users. But a lot of the time everything can be open for negotiation. This one is a myth but also not 😂.
Do you agree?
Have a lovely weekend!
