• The “border search” justification is being stretched — border searches historically get more leeway under the Fourth Amendment, but critics argue using that leeway to investigate protest-movement ties (rather than customs/immigration matters) goes beyond its purpose
• Treating a privacy tool as inherently criminal could chill anyone’s choice to use encryption or auto-wipe features, not just protesters
• Cybersecurity experts say this may be the first time this statute has been aimed at an operating system, and worry it sends the message that privacy tools are “criminal by default”

A judge’s decision on the motion to suppress evidence won’t come before late October.
