This is what I saw today walking by the Club at Brickell Bay around 11am, which I can only guess equates to “check out time” for most of the illegal Airbnb businesses running out of this residential condo. It is incredibly obvious to everyone living in this neighborhood in Brickell Bay that this building is largely running as an illegal and unregulated hotel operation. I remember the day someone told me it actually wasn’t a hotel - I was shocked. The only people I see come in and out of this building either have suitcases or are very clearly tourists. The question is why has it seemed to not be so obvious to our government and why has action against this illegal operation been so slow? When criminal activity is not penalized, it continues to grow and spread because people understand they can get away with it. This is what we understand has been happening throughout our neighborhood as other potential illegal short-term rental operations continued to be identified. We need action against this now and we need regulation of short-term rentals to ensure we don’t have risks to life and safety. by @onlynbrickell

Illegal, short-term rentals have spread like a virus throughout Brickell. While most in Miami know about an infamous building with this issue, further investigation has uncovered a growing network of illegal, short-term rentals spreading across our community. Regulating short-term rentals is not anti-capitalist - this has become an issue of public safety and infrastructure. There is a clear strain on community infrastructure that results from a constant revolving door from an onslaught of visitors (often with no background checks) in residential buildings not built to support commercial turnover as a hotel. Consequences are not just internal to the buildings (destruction of community property, noise and safety, etc) but also to our entire community. Large volumes of visitors brings a strain on public services like waste management and crime prevention. We have even seen cases where visitors using these illegal rentals have sadly lost their life due to negligent safety standards. It is important for residents and the community to feel safe in their homes. While condos may be able to take some efforts to prevent this (biometric access, increasing minimum rental period, front desk training, etc.) the issue is harder to mitigate when the board itself is profiting from this illegal activity, possibly not even living onsite, and creates a culture of fear and intimidation for residents opposing this criminal activity. Thank you to the @miamiherald and the @brickellhomeowners for being community partners in the battle to shine a light on this growing issue. We understand the city will be implementing a task force by end of year to help gain better control of mitigating this issue amidst state regulations pre-empting city limiting ability to enforce violations. Brickell has waited too long to tackle this issue and our neighborhood needs support critically to fight against bad actors looking only to profit from our neighborhood at the expense of our community’s best interests. Does new construction really replace the trees lost? If you ask Miami residents why they don’t believe this, it’s because of the reality and we have proof right on Brickell Bay Dr. Most new construction seems to destroy significant preexisting, shady tree canopy and final projects end up with little to no tree canopy - sometimes not even real grass. Just look at the Panorama, the newest building on our street finished in 2018. There are NO trees on the public walkway - just small bushes in a completely paved space. And whatever little grass exists is not real grass - it’s plastic astroturf! The only trees are small palms up on the pool deck. 🙃 It’s always incredibly hot to walk on this side, which is why I see a lot of neighbors cross directly to where the Yacht Club at Brickell is, which is older construction finished in 1998. There is significant tree canopy and shade surrounding this older building. Need convincing of the damage done? Take a look at the before and after (credit: @miami.dealmakers) - SO many trees existed and now we have 0 trees on this block. No wonder heat and flooding is out of control. Other new construction on our street like Brickell House also have noticeably little to no trees around their property and also use astroturf! What is particularly concerning is most older construction with existing tree canopy were all recently sold: the Yacht Club, 1001 Brickell Bay Dr office and and Jackson Cottage all will leave our street, along possibly with the significant tree canopies surrounding these properties. This kind of tree and soil loss exacerbates flooding in an already deeply flooded area and someone needs to be thinking about the big picture. We need our government to be pushing developers to relocate tree canopy that conflicts with construction and ensure they only add more trees to projects to support climate resiliency and quality of life - or we continue to elevate the risk of disastrous flooding, heat and the the reduction of our neighborhood’s value and desirability. Can we fix this by adding more shade trees to the public walkways and removing astroturf?
