In a major ruling on religious conversion and caste-based reservations, the Supreme Court on Thursday, October 15, held that individuals converting from Hinduism to Islam or other religions cannot automatically claim reservation benefits based on their previous caste or social status.

A bench comprising Justices Prashant Kumar Mishra and Shree Chandrashekhar upheld a Madras High Court judgment, ruling that social backwardness associated with a person’s original caste cannot automatically be transferred to a different religious community after conversion.

The court clarified that converting to Islam does not automatically make someone eligible for reservation under the Backward Class Muslim category. A person’s previous caste identity alone cannot establish membership in a separately recognised backward community.

The judgment came after the Tamil Nadu government challenged a Madras High Court decision striking down a 2024 government order. The order had allowed individuals belonging to Backward Classes, Most Backward Classes, Denotified Communities and Scheduled Castes who converted to Islam to obtain community certificates under seven notified Muslim backward communities.

The dispute originated when a man who converted from Hinduism to Islam sought a Backward Class Muslim certificate identifying himself as belonging to the Labbai community. After authorities rejected his application, the matter reached the courts.

The Supreme Court also reiterated that under the Constitution (Scheduled Castes) Order, 1950, Scheduled Caste status is legally recognised only for people professing Hinduism, Sikhism or Buddhism. Conversion to another religion results in the loss of that status under the existing constitutional framework.

However, the ruling does not mean that all non-Hindus are barred from reservation. It distinguishes between automatically carrying forward a previous caste-based entitlement and independently qualifying under a legally recognised reservation category. Scheduled Tribe eligibility is also governed by separate provisions.
