New White House Press Secretary Katie Zacharia has confirmed she never passed the bar exam, even though she has repeatedly referred to herself as a lawyer in public appearances and President Donald Trump described her as an attorney when announcing her appointment.

Zacharia, who graduated from Pepperdine University’s Caruso School of Law in 2011 with a juris doctor degree, sat for the California bar exam that year but did not pass, according to a person with direct knowledge of the matter cited by The Wall Street Journal. She took the exam around the time she was planning a wedding and preparing to move to China with her then-future husband. Zacharia herself acknowledged the failure in an interview with conservative commentator Jack Posobiec after the reports emerged, saying she was distracted by the wedding and move and “didn’t think much” of the results. She added that she did not need to pass to do her work in China.

There is no public record of Zacharia being admitted to the bar in California, Texas, Washington, D.C., or any other U.S. jurisdiction under her married or maiden name (Black). The State Bar of California has stated it has no record of her ever being licensed there and that she never appeared on a California bar exam pass list.

When reporters asked her on the South Lawn earlier this week where she had passed the bar, Zacharia replied, “When I moved to China.” She later told The New York Times that she misheard the question over the noise and thought she was being asked where she went after law school. She has also said she consulted with Pepperdine’s president and others before appearing on cable news and was advised she could call herself a “lawyer” but not an “attorney” or “esquire.”

After law school, Zacharia moved to Beijing and worked from 2011-2013 as an associate on the international-practice team at Zhong Lun. Legal experts note that foreign nationals cannot sit for China’s bar exam or practice Chinese law; such roles for non-citizens are typically limited to supporting cross-border work or consulting. A partner at the firm told the Times the position was likely similar to a paid internship.
