Over the past month, I’ve been sharing more from my travels, and seeing different parts of the world has been a life-changing experience.

As things begin to settle back into a normal rhythm, it feels like the right time to reintroduce myself.

I’m Perminder, a BC-based lawyer and mediator serving clients in Langley, the Fraser Valley, Vancouver and beyond. I’m also a Partner at Lindsay Kenney LLP (@lklawca) and a dedicated advocate for clients navigating estate disputes, personal injury matters, workplace harassment, and more.

Since being called to the Bar in 2009, I’ve built my practice around a commitment to my clients, many of whom come to me during some of the most stressful and challenging times in their lives.

No Will? In BC, that means the law decides who gets what.

Dying without a Will, also known as dying intestate, often leads to significant confusion, stress, and even conflict in estate distribution conversations among surviving family members. When someone dies intestate, the law determines how the estate is handled—not you, and not your family.

Under the Wills, Estates and Succession Act (WESA), there’s a set order of who gets an inheritance. This typically goes to the spouse and children of the deceased first. If there is no spouse or child, it would then be passed on to surviving parents, siblings, or even more distant family members.

In addition to the uncontrolled way the inheritance is dispersed, there are other downsides. The courts will appoint an administrator, which is time-consuming and takes money out of the estate. And if you are the long-term (but unmarried) partner of the deceased, there’s a good chance you would receive nothing if you weren’t explicitly named in a Will.

There are so many uncertainties that come with intestate estates. And when you compare those to the relatively quick process of creating and updating a Will, you can start to see why this is one job to get squared away as soon as possible.

Recently had the opportunity to attend the South Asian Bar Association of BC (@saba.bc) Gala.

This event is always a wonderful celebration of the South Asian legal community, and this year’s soirée was no exception. It was an evening filled with meaningful speeches, well-deserved awards, and the opportunity to connect with both new and old friends.

It was also great to see the introduction of the Gala Awards nominated by our community, and a special congratulations to the Honourable Wally Oppal KC on receiving the Lifetime Achievement Award, a fitting recognition of his remarkable contributions to the legal profession and our community.

What happens if a Will’s named executor can’t (or won’t) act in their role?

Being named as an executor is an honour, but it’s not an obligation. An executor has the right to say no to this duty if they choose. There are two possible outcomes if that happens:

◾️ Option 1 – Alternates: If an alternate executor is named in the Will, the responsibility shifts to that person.

◾️Option 2 – Court-Appointed Administrator: If no alternate is named, someone else may need to apply to the court to administer the estate. Who has priority to apply will depend on the circumstances and the terms of the Will. This process can take much longer than you might expect.

While the person ultimately appointed will be responsible for administering your estate according to the Will and the law, it doesn’t change the fact that they weren’t your first (or second) choice. That’s why naming an executor AND a backup executor is so vital. It’s a relatively simple update to consider when reviewing your Will that can save your family a much, much longer process later on.

Today, we pause to reflect.

It’s the National Day for Truth and Reconciliation. It’s a time for us to solemnly remember the injustices endured by Canada’s Indigenous Peoples, honour the survivors of residential schools and colonialism, and look to a future of reconciliation.

While many of these events occurred generations ago, the impacts are felt in Indigenous communities nationwide to this day. I hope members of my community will join me today in learning about the true history of Canada, lifting up Indigenous voices, and standing in solidarity.

Can you still go to court after trying mediation, or are you locked in?

One of the number one reasons to try and solve a dispute through mediation is flexibility. Unlike arbitration or litigation, which are ruled upon by a legal authority, mediation is completely non-obligatory. 

This means that you’re not legally bound by anything that occurs in mediation until you sign a contract. If you or the other party reconsiders the arrangement, you still have the option to pursue a case against the other party in court.

This is the reason I suggest my clients try mediation whenever possible. If you’re able to find a resolution, it’s far faster, less stressful, and less expensive to do so through mediation.

Do you have to report to police before you can file a civil claim in BC? ⚖️

Generally, no. Civil and criminal proceedings are separate processes, which means you do not need to make a police report or have criminal charges laid in order to pursue a civil claim.

For someone who has been through something difficult, deciding whether to involve the police can feel overwhelming. You may not be ready to take that step, or you may simply want to understand what other options are available to you.

Depending on the circumstances, you may be able to report what happened, pursue a civil claim, or do both. Choosing not to report to police does not necessarily mean you have given up your ability to seek a remedy through the civil courts.

What matters is understanding your options and any deadlines that may apply, so you can make an informed decision that feels right for your situation.

Most people know they should have a Will, but fewer people think about what would happen if they were still alive and suddenly unable to manage their own financial affairs.

If an accident or illness left you unable to deal with your banking, bills, property, or other financial matters, who would be able to step in? Having the right Power of Attorney in place can make that answer much clearer for you and your family.

In B.C., an Enduring Power of Attorney can continue even if you become incapable of managing your financial affairs. A Will, on the other hand, deals with your estate after you die. One helps with decisions during your lifetime; the other helps carry out your wishes afterward.

They serve different purposes, and one does not replace the other. Thinking about both is part of making sure the people you trust are not left trying to figure things out during an already difficult time.

Surviving SA is already extremely difficult, which is why it’s up to us to show our support after the fact. This means believing them without needing every detail, letting them set the pace of disclosure, and not asking why they didn’t act sooner.

For survivors, legal options for closure, compensation, and justice exist, and there’s no time limit on pursuing them. When they’re ready, they can sit down with a lawyer and explore these pathways.

Support for survivors of SA can come in many forms, and no one can decide the right course except for the survivors themselves.

The responsibility for what happened lies with the person who caused the harm, never with the survivor. Of course, internalizing this knowledge is often a challenge, which is why exploring legal options can be a powerful next step.

Talking to lawyers after surviving SA doesn’t mean you’re automatically jumping into action. In many cases, my work with survivors begins in an exploratory capacity. We discuss potential avenues to receive justice, compensation, and closure, and only move ahead if or when my client feels ready.

No matter the situation or what you survived, remember that you don’t need to make every decision at once. If now isn’t the right time to explore legal options, that’s okay as well. Always begin with the support that feels appropriate for you, whether that’s talking to lawyers, exploring the possibility of a civil SA claim, or just taking the time and space you need to begin healing.
