Collectibles, jewelry, art, and other valuable personal property can be part of your estate plan too.

If an item has substantial financial or sentimental value, placing it in a trust may help ensure it is managed and ultimately distributed according to your wishes.

Estate planning is not just about your home or your bank accounts. The valuable things you own deserve a plan too.

How well do you know the rules of a New York real estate transaction?

An accepted offer does not mean the house is officially yours. A buyer can lose their deposit for backing out under the wrong circumstances. Sellers may still consider other offers before contracts are signed. And even when you think you are clear to close, issues can still come up.

From inspections and financing to municipal searches and due diligence, the details matter all the way through closing.

Swipe through Part 3 of Yes or No with Rolo Law and see how many you get right.

Buying a house with someone you are not married to can create serious legal and financial complications if the relationship ends.

Who is on the deed? Who contributed the down payment? What happens if one person wants out? Without an agreement in place, the answers may be very different from what either person expected.

If you are purchasing property with a boyfriend or girlfriend, talk to a real estate attorney before you close. A little planning upfront can protect both your investment and your interests if circumstances change.

Selling a property “as is” does not mean a seller can simply wash their hands of every issue with the home.

In New York, sellers still have disclosure obligations. An “as is” sale may mean the buyer accepts the property in its current condition, but it does not give a seller permission to intentionally hide or misrepresent known material defects.

The key is transparency. If you know about an issue, assuming the words “as is” protect you could create problems long after the closing table.

If you die without a will, you are leaving the distribution of your estate up to New York’s default rules, not your own wishes.

These are called intestacy laws, and they determine which relatives inherit your property when there is no valid will in place. That distribution may look very different from what you would have chosen yourself.

A will gives you the opportunity to make those decisions ahead of time instead of relying on the default.

A buyer backing out of a real estate deal does not automatically mean the seller gets to keep the deposit.

Even when a buyer defaults, what happens to that money can depend on the contract, the circumstances surrounding the default, and whether both parties agree to release the funds. If there is a dispute, additional legal steps may be necessary before anyone receives the deposit.

Real estate contracts come with obligations on both sides. Before assuming you are entitled to the deposit, make sure you understand what the contract actually allows.

That first insurance settlement offer may not reflect the full value of your claim.

Insurance companies negotiate claims every day. An experienced personal injury attorney can evaluate your case, handle those negotiations, and advocate for fair compensation.

Before you accept an offer, understand what your case may actually be worth.

Why does buying a home in New York seem to take so long?

New York real estate closings involve multiple parties, legal requirements, title work, financing, and plenty of moving pieces behind the scenes.

Understanding the process before you buy can help you know what to expect and avoid unnecessary surprises along the way.

Putting your home into a trust changes who holds legal title to the property, but the details matter.

Revocable and irrevocable trusts can have very different implications, especially when it comes to Medicaid planning and protecting assets. The way the trust is structured matters.

Planning ahead can make all the difference.

If you are flipping houses, the way you structure the purchase matters just as much as the property you choose.

Renovations come with risk. Contractors and other workers may be on the property throughout the project, and if someone is injured, the property owner could potentially face a claim.

That is one reason investors often purchase properties through an LLC rather than in their individual name. When properly structured and maintained, an LLC can provide a layer of separation between business liabilities and personal assets.

There may also be tax considerations depending on how your real estate business is structured, which is something to discuss with the appropriate legal and tax professionals before purchasing.

If real estate investing is a business, treat it like one. Think about liability, ownership, insurance, and your business structure before the renovation ever begins.
