See y’all tomorrow Texas ✊ we still rally every Sunday for Big Bend at 10AM! Here’s what happened this week and what’s next as Save Big Bend rallies continue. - We got great news. The government has paused all construction in BBT2 & BBT4 through September. That’s the National Park, the State Park, and a lot of good people’s land. This is a huge victory and gives us the opportunity to make a sustained push for transparency and the cancellation of these illegal contracts.  - When we say this is about Texans and their land, we’re talking about people who have lived here for generations - some for thousands of years - who believe in good stewardship to our home and heritage forever.  - Let’s show some love to @rolandfortexas @peopleoflajunta @bigbendfarflung and everyone speaking up for what’s right. Y’alls voices have been a beacon of hope for so many people.  Last week we had 200+ community members gather in San Antonio, 40+ on the Montrose overpass in Houston and three more rallies with dozens in Austin, SATX & Dallas. Texans everywhere are standing up against data centers, government surveillance, and indefensible, illegal public lands policy. We are going to win. ✊❤️ Remember - you must hold your sign. They’re waiving numerous legal protections to build 150+ miles of border wall and razor wire inside our national park and the greater Big Bend region this summer: a measure no one supports. This would be the end of Big Bend as we know it, robbing future generations of the river, the stars, the ecosystem, and our heritage forever. About a week ago, local west Texas landowners and businessowners were joined by public lands lovers nationwide to celebrate a federal court ruling (by a Republican-appointed judge, no less) that stopped all border construction in the Big Bend Sector. However, less than a week later, the Department of Homeland Security made its next move. As expected: as hard as the locals in Big Bend have fought to save their property and protect their way of life, Homeland Security isn’t giving up its attempts to destroy those things either. On Thursday, October 8, the agency filed a motion to "stay" the preliminary injunction. In plain words, that means halt, pause, postpone, or suspend the court ruling, which would allow DHS to resume border construction right away. But they went further. “The Office of the Solicitor General intends to seek Supreme Court review of this Court’s preliminary injunction,” the DHS motion says. “If an immediate stay is not granted by this Court, Defendants intend to seek expedited relief in the Supreme Court.” “The government’s compelling interests plainly outweigh whatever environmental, aesthetic and recreational injuries plaintiffs and their members may incur if the district court’s injunction remains in place,” the Trump administration’s attorneys wrote. So, the Big Bend border barrier dispute is very likely headed to the Supreme Court. That would be absolutely huge. If the conservative court takes the case—and that's a big, big if—it will end up ruling on the conflict between federal construction projects and private property rights in rural Texas, of all places. It will then also rule on the federal government's authority to waive all kinds of environmental laws to destroy natural areas at will. For now, construction remains halted across the entire Big Bend Sector, including Big Bend National Park. But this might end up in the hands of the majority right-wing Supreme Court judges, and it will be absolutely fascinating to see how they deal with this. EDIT - THIS CASE IS BEING PETITIONED TO THE SUPREME COURT. If they reverse the injunction, we protest absolutely everywhere we can. FEDERAL JUDGE ISSUES AN EMERGENCY INJUNCTION - yesterday in El Paso, a judge ruled to stop all border construction in the Big Bend region pending a final ruling in the case. A million thanks to @centerforbiodiv @txcivilrights @laiken_jordahl @ruidosachurch & everyone in the struggle - we love y’all ✊❤️ WE ARE PAUSING WEEKLY PROTESTS until there is an update on the case! This case will likely result in a permanent injunction, but it may be challenged up to the Supreme Court. We’ll be ready if it is. EL PASO RALLY IS HERE - Next Friday 10/2 @centerforbiodiv, @TXCivilRightsProject, @ruidosachurch , and a Big Bend river guide & landowner are seeking an injunction to stop border construction across Big Bend National Park and across the whole Big Bend Region — and y’all can help. There will be a peaceful and positive demonstration on the sidewalk outside the federal courthouse at 8AM, 1 hr before the hearing begins. Bring banners, colorful signs, and all your friends! Details: 8AM, Friday 10/2 - Federal Courthouse - 525 Magoffin Ave, El Paso - We are asking people to meet on the sidewalk at the SW corner on E San Antonio Ave and to respect the space of the courthouse. While lawsuits and other official actions progress, it’s more important than ever that we make our voices heard and stand in unity with our neighbors. A month ago, 200+ community members gathered in San Antonio to show solidarity with plaintiffs in another successful hearing, and we’d love to keep the positive news coming for Big Bend. Terrell County in project area BBT-5 just gave Fisher Industries a big foothold in the region despite constituents’ opposition to the proposed agreement. Locals showed up to court multiple times to speak against the item, saw it tabled, presented an alternative offer, and still were let down. It’s incredibly disappointing to see the court move forward with this agreement to lease land to the contractor that was awarded $2.6B (the largest border barrier contract in U.S. history) to construct roads, bridges, and barriers where they’re entirely unnecessary. Since our own local leaders won’t stand up for us, we are just going to have to keep showing up for each other and supporting our friends and neighbors that are directly harmed by this decision. @yellowbrickartco has their grand opening this weekend!!!! So much love and energy has been poured into this art and I’m so excited for my sweet friend to finally see her studio open to the public!!! There’s gonna be so much goodness happening all day Saturday and then a rally on Sunday morning to follow!
