Transparency Saves Lives: Why we need SB 2086 in Hawaii. 🏛️⚖️
For too long, Hawaii’s legal system has allowed a dangerous loophole: “Total Sealing.”
When a doctor is sued for malpractice or sexual assault, they can settle the case privately and have the entire court record hidden from the public—and sometimes even from the Medical Board. This means a surgeon can have a history of predatory behavior, yet their public license remains “clean.”
In January 2026, the Hawaii Supreme Court (Case SCPW-24-0000484) took a massive step for patient safety. They ruled that the “total sealing” of records for Dr. S. Lawrence Schlesinger and Phoenix Group LLC was unconstitutional. The Court made it clear: the public’s right to know about these allegations outweighs a provider’s desire for secrecy.
But we shouldn’t have to fight all the way to the Supreme Court just to know our doctors’ history.
That is why SB 2086 is so critical. This bill will:
✅ Require that settlements involving sexual assault be reported to the licensing board.
✅ Stop “doctor-hopping” by ensuring patterns of behavior are tracked.
✅ Prioritize patient safety over professional reputation.
Check the facts for yourself. You can read the Supreme Court’s public order here:

It’s time to close the “sealing loophole.” Our community deserves transparency, and our patients deserve safety.
