You followed me to the caption🥰
You'd enjoy this for sure

So what is this 'BUT'?

Once again, it's in THE LAW🌚

The law truly doesn't allow identical trademarks BUT:

Where the Tradmark is in a different class of good, the law will allow it to be recognised and registered.

For example, if Dangote Sugar's mark is similar with the mark of Lontor Lamp, the law will allow such mark to exist because they're in different classes.

Dangote's goods are Sugar
Lontor's goods are Lamps

They're in different classes so having similar mark won't be confusing

So once again, where the Trademark is similar, but for different goods belonging to different owners, the law will allow it.

Hello IP Lovers😊😊
This week's TRIBAL THURSDAY is on the subject of TRADEMARK 👀

Trademark can be any word, phrase, symbol, design, or a combination of these things that identifies your goods or services.

It helps your customers recognize you in the marketplace and distinguish you from your competitors.

Hope our business men and women are here?👀😂

But of course, there's more to Trademark than this summarized definition, so join us tomorrow by 5pm on our blog page (Link in Bio) to learn more on the subject of Trademark 😉

Maxims are brief statements of fundamental principles that apply to a lot of situations and are usually in Latin cause really, they've been in existence long before our beloved country was formed. They are fondly used by lawyers, judges etc to describe how the law works, like the one up above, it basically describes the law, hence the name "legal maxim".

They are also really helpful when it comes to avoiding common errors and issues, like the one explained here, it's usually applied in criminal law and helps to avoid errors when a person is fored to commit a crime and this particular legal maxim explains that if you're forced to commit an act, then that act isn't yours.

And honestly ehn, we believe that if this is the case then you shouldn't be punished for the forced act.

For instance, you know how in movies, armed robbers, while pointing a gun to a banker asks her to put all the money into a bag? Yeah, in that case, the banker obviously would do that, but this maxim states explains that, the forced act (pouring the money) is not the act of the banker.

So that's the gist about legal maxims and this particular maxim. Get ready, you'd be seeing so much more of these😉
