South Australia is poised to introduce some of the toughest building‑licence penalties in the nation. The Statutes Amendment (Building and Construction Industry Review—Penalties) Bill 2025 was introduced on 15 October 2025. It proposes to insert section 47A into the Building Work Contractors Act, prohibiting licensed builders from contracting unlicensed subcontractors. Breaching this prohibition could attract penalties up to $100 000 for individuals or $500 000 for companies. Other provisions make it illegal to use another person’s licence and dramatically increase penalties for taking payment in advance of work: the maximum penalty would jump from $5 000 to $100 000 for individuals and $500 000 for corporations. These measures respond to industry concerns about poor workmanship, unlicensed trades and cash‑flow abuses. The Bill also acknowledges that workforce shortages and high demand have contributed to declining standards. If passed, the amendments will reshape South Australian building practice. Builders will need to verify the licences of every subcontractor before engagement, and subcontractors may need to upgrade their licences through additional training. Prospective licensees should act now: ensure your own licence covers all work you perform and audit the credentials of your network. In a market where skill shortages are acute, compliance and professionalism will distinguish successful operators. Queensland’s licensing regime is evolving under the Building Reg Reno. On 1 February 2026 the Queensland Building and Construction Commission and Other Legislation Amendment Regulation 2026 commenced. The changes clarify that licence applicants must pay two separate fees—a licence application fee when applying and a licence fee upon grant—and refine fee waiver provisions. The amendment also introduces a new infringement notice for section 109C of the QBCC Act: non‑compliance can now be addressed with an on‑the‑spot fine of 1 penalty unit (currently $154). This lowers the enforcement barrier and increases the likelihood of immediate penalties. Licensees must keep their contact details current as the QBCC has switched to email as the primary communication channel—missing an email is no defence. For builders, these updates mean greater scrutiny and quicker enforcement. Understand which fees apply to your pathway, ensure your QBCC profile is up to date, and adopt a compliance‑first mindset. Combining these regulatory shifts with Australia’s looming labour shortage—90 000 additional workers needed by 2025—highlights the importance of professionalism. Train your workforce, prioritise safety and avoid shortcuts that could trigger infringement notices. Victoria is overhauling how domestic builders prove their financial capacity. The state’s Regulatory Impact Statement on Minimum Financial Requirements (MFR) proposes that builders must maintain a current ratio of at least 1:1 and hold Net Tangible Assets (NTA) proportional to the scale of work. Annual revenue cannot exceed 20 times the NTA—meaning NTA must be at least 5 % of revenue. If builders expect to exceed their allowable revenue, they must notify the regulator. The changes are slated to apply to new applicants from 1 July 2026, with phased compliance for existing builders depending on business size. While regulators argue the reforms will improve financial sustainability and consumer confidence, Master Builders Victoria warns they could unintentionally constrain capable small and medium operators already grappling with rising costs and labour shortages. With workforce shortages hitting 90 000 additional workers by 2025, imposing stricter financial thresholds could deter new entrants and make it harder to scale businesses. Builders should review their balance sheets, work closely with accountants and prepare to demonstrate financial resilience. Consider diversifying revenue streams, strengthening cash flow management and investing in apprenticeships—tomorrow’s compliance environment will reward those who plan ahead. The final version of the National Construction Code (NCC 2025) was published in May 2026 and will not take effect in New South Wales until 1 May 2027. This extended transition period gives NSW builders more time than other states to get ready for sweeping reforms. Master Builders NSW emphasises that reform must be predictable and nationally consistent; yet the state still faces the challenge of educating contractors about condensation management, waterproofing and energy‑efficiency provisions before the 2027 deadline. Beyond code compliance, federal policy will remove the paywall on all Australian Standards referenced in legislation. Free access should lower costs for small operators but will also expose any knowledge gaps; staying up‑to‑date with standards is critical. Meanwhile, a national labour crunch looms: Australia needs 90 000 additional construction workers by the end of 2025 and 130 000 by 2029. One in four construction businesses has job vacancies and 85 % struggle to find suitably qualified workers. A shortage of trained supervisors could leave NSW employers scrambling to meet demand just as regulations tighten. New NCC requirements combined with labour shortages mean aspiring contractors should start preparing now. Review your competencies against NCC 2025, enrol in training on waterproofing and condensation management, and plan for changes to energy‑efficiency provisions. Keep records of professional development and consider mentoring apprentices—the industry desperately needs new talent.
