At 12:01 a.m. on October 1, 2025, the federal government shut down. For federal contractors, the consequences reach far beyond delayed payments—implicating employment law, compliance, and workforce management.

WARN Act
Extended furloughs or significant hour reductions may trigger federal WARN Act or stricter state “mini-WARN” obligations. Conditional notices may be required, and exceptions like the “unforeseeable business circumstances” defense are fact-specific.

Wage and Hour

* Non-exempt employees: paid only for hours worked (subject to state law).
* Exempt employees: entitled to a full week’s salary if they perform any work. Employers should bar work during full-week furloughs.
* PTO: Employers may mandate use, but state law governs.

Benefits
Furloughs may cause loss of group health coverage, COBRA eligibility, or 401(k) withdrawals. Short-term savings must be weighed against long-term compliance costs.

Immigration
H-1B, H-2B, and E-3 workers must be paid at the required wage regardless of shutdowns. Furloughs or salary changes may require amended filings. E-Verify will be offline, though I-9 obligations remain. Employers may not act on pending Tentative Non-Confirmations until systems return.

Unions
Shutdowns can trigger collective bargaining obligations, including seniority, layoff order, and notice requirements. Even with the NLRB largely closed, bargaining duties remain in force.

Agencies and Courts

* EEOC: 95% furlough, no new investigations or mediations.
* DOL: More than 11,000 furloughs; Wage and Hour reduced to seven staff.
* OSHA: Only imminent-danger inspections will continue.
* NLRB: Nearly all operations halted.
* Federal courts: May close entirely by mid-October without new funding.

Employee Communication
Clear communication is critical to avoid misinformation and preserve morale. Employers should:

* Share contingency plans.
* Provide updates, even if monitoring only.
* Train managers on consistent messaging.

Bottom Line
Federal contractors should act now: review WARN obligations, wage and hour rules, benefits, immigration filings, and union agreements, while ensuring employees are informed and supported.

Mind stronger than the body. Broken bones don’t break dreams. Finished what I started, even with one hand down. 🥈
