WHO OWNS THE WORK YOUR AI TOOL HELPED CREATE?

A company uses AI to develop a marketing campaign.

Another uses it to build software.

Another uses AI to create images, proposals, reports or other business content.

The work is delivered. The client pays. Everyone moves on.

But there is a question that businesses should ask before getting to that point:

Who actually owns the work?

Using an AI tool does not, by itself, determine ownership, authorship, licensing rights or other intellectual property rights in the resulting work.

Businesses should consider, among other things:

1. What do the AI tool’s terms provide?
Do they address ownership, licensing, permitted use and commercialisation of outputs?

2. What went into the output?
Could third party, copyrighted or otherwise protected material have been incorporated into the work?

3. Can the output be legally commercialised?
Ownership and the right to use or commercialise an output are not necessarily the same thing.

4. Who owns the underlying intellectual property?
Where employees, consultants or contractors are involved, the relevant employment or contractual arrangements should clearly address ownership and assignment of intellectual property.

5. What information was provided to the AI tool?
Confidential, proprietary or client information should not be submitted without first considering the applicable confidentiality, data protection and contractual obligations.

6. What happens if ownership is challenged later?

A client may receive the work, but that does not necessarily resolve questions surrounding the rights attached to it.

AI can make businesses faster, more efficient and more productive.

But speed should not come at the expense of legal due diligence.

As businesses increasingly integrate AI into their operations, intellectual property, confidentiality and contractual considerations should be addressed before AI generated output becomes a commercial asset.

The question is no longer simply:

“Can AI create it?”

The more important business question is:

“Can we legally use it, own it and commercialise it?”

Technology law definitely is a new aspect of law that has come into the Nigerian law sphere but still has other input of other areas of law.
On the 18th of April 2024, the Technology Law Club had its first meeting, which was a mentorship session with Theophilus Aigbogun.
We learnt a few things like the types of areas of tech law. We also learnt what one needs to know and do as a tech lawyer, and to stay in vogue and be influential in the space.
The speaker shared 3 key things, which are:
. *Be conversant with Tech.*
. *Know the law that applies to tech.*
. *Network*
We also learnt about the regulatory bodies and frameworks for tech law, e.g., CBN, SEC, and FCCPC.
The mentorship session was such an impactful one, and we extend our gratitude to Theophilus Aigbogun for taking out time to share knowledge with us.

Officially had my #uwegraduation from @uwebristol last week. 💃🏽
LLM International Banking and Finance Law in the bag.
Thank you Heavenly Father 🥹

I don’t have words to describe slide 1. All I can say is thank you @manniiso for this shot that lasted a split second, yet it was captured. My stock photo collection has just grown by 1.

Who else to thank but @thetechattorney for capturing the video in slide 2 that facilitated the gesture in slide one, and consequently led to the iconic photo.

In this life, it’s a blessing to have skilled hands capture treasured moments for you…. In HD quality and with right perspective and lighting 🌚

It’s been a few days but I’m still overwhelm with emotions and gratitude, to God, to all my friends, to my family, to myself for holding together through all of this.

This is only the beginning of many more achievements, treasured memories, victories to come. The sacrifices, pains, mistakes, small wins, were and will always be worth it in the end.

Leye don’t lose heart. Likewise, whoever reading this, be strengthened and forge on.💪🏽🏇🏽
