🏠 SELLING A TENANTED PROPERTY IN ONTARIO: THE PROS & CONS ⚖️

Thinking about selling your rental property? In Ontario, tenants do not automatically have to vacate just because a home is listed. That means you have a choice: sell with tenants in place or wait for vacancy.

Here is the quick breakdown of what you need to know before putting up the sign 👇

✅ THE PROS:
Continuous Cash Flow: You collect rental income right up until the closing date—no carrying costs while the home is on the market.
Turnkey for Investors: A reliable, paying tenant can make the property an attractive, ready-to-go asset for buy-and-hold investors.

❌ THE CONS:
Smaller Buyer Pool: Most end-user buyers want vacant possession upon closing. Inheriting a tenant—and the risk of Landlord and Tenant Board (LTB) delays if they don't leave—scares many buyers away.
Showing Restrictions: Ontario law mandates a minimum 24 hours written notice before every showing, which limits spontaneous viewings.
Less Control Over Presentation: Staging, cleanliness, and clutter are in the tenant's hands, which can directly affect buyer perception and sale price.

💡 THE SMART STRATEGY:
Cooperation is everything. Offering financial incentives for showing flexibility, or negotiating a mutual agreement to end the tenancy (Form N11) before listing, often yields a significantly higher final sale price.

Navigating tenanted property sales requires careful planning and strict adherence to Ontario tenancy rules. Want to know the best strategy for your specific property? Send us a DM! 📲

📄 DEALING WITH CHRONICALLY LATE RENT? MEET THE N8 FORM ⏱️

If a tenant doesn't pay rent, landlords serve an N4. But what happens when a tenant does pay, yet they are consistently late month after month?

That is where Ontario’s Form N8 (Notice to End your Tenancy at the End of the Term) comes in.

📌 THE QUICK BREAKDOWN ON FORM N8:
The Primary Reason: Persistent late payment of rent. Even if arrears are eventually paid, a continuous pattern of late payments gives landlords grounds to terminate the tenancy at the end of the term.

The 60-Day Rule: For monthly or annual tenancies, the termination date must be at least 60 days after the notice is served and must align with the last day of the rental period (usually the day before rent is due).

The Paper Trail Matters: To succeed at the Landlord and Tenant Board (LTB), landlords must provide clear proof of a consistent pattern—such as payment records, bank statements, NSF fees, and written payment reminders over several consecutive months.

Other Grounds: Form N8 is also used if a tenancy was tied to employment that ended, or if the tenant no longer qualifies for designated subsidized housing.

💡 Pro Tip: Document every single transaction. If late payments are becoming a habit, don't wait until the situation spirals—establish a clear, objective record from day one.

Most agents don't fail because of talent. They fail because they run their business on sticky notes and memory.

That's why I built the Elevate Agent Planner for my agents. Everything in one app: daily actions, prospecting, client events, schedule, deals, top clients, triple plays, referrals, social content, compass, vision board and notes. One place to plan your day, stay on track, and actually follow up.

This isn't something you buy. It's exclusive to RE/MAX Elevate agents.

If you're an agent who wants structure, coaching and a brokerage that invests in your growth, come see what we're building.

🏡 Landlord Tip! 🔧

Own a rental property? Don’t forget to check your furnace filter! 🏠 Tenants don’t always change it regularly, and a dirty filter can restrict airflow and make your furnace work harder.

✅ Check it regularly
✅ Replace it when needed
✅ Protect your investment!

A little maintenance today can save you headaches tomorrow! 💰

⚖️ ONTARIO CUTS THE N4 NOTICE IN HALF: DOES IT FIX THE REAL PROBLEM? ⏱️

Major regulatory updates are in effect for Ontario rental housing! Under updates through Bill 60, the mandatory notice period for non-payment of rent (Form N4) has dropped from 14 days down to 7 days.

This lets landlords file an L1 application with the Landlord and Tenant Board (LTB) a full week sooner. But does it solve the deeper backlog? Here is what you must know 👇

📋 WHAT CHANGED WITH THE NEW N4?
• 7-Day Window: The notice period to pay arrears or vacate is cut from 14 to 7 days for monthly leases.
• Mandatory Form: Landlords must use the updated LTB N4 form; older versions render the notice void.
• Right to Void: Tenants can cancel the notice by paying lawful arrears before an application is filed.
• Service Rules: The 7-day clock starts only after delivery. When mailing, add 5 days for delivery.

⚠️ THE ROOT HURDLE: LTB DELAYS
Saving 7 days at the start offers limited relief when the tribunal remains backlogged.
• Days vs. Months: Gaining a week upfront means little when wait times to secure L1 hearings take months.
• Order Delays: Waiting for written eviction orders and Sheriff enforcement adds further weeks to the process.
• Less Time to Cooperate: A tight 7-day window gives tenants less buffer for temporary payroll delays, pushing cases to court that could be resolved amicably.

💡 KEY TAKEAWAYS FOR PROPERTY OWNERS
• Track Rent on Day One: Reconcile rent on the due date to protect the benefit of the shorter timeline.
• Ensure Accuracy: Clerical errors or adding utility charges will invalidate your notice.
• Screen Thoroughly: Comprehensive tenant vetting remains your best defense.
