A lot of people start making money before they ever think about the legal structure of their business. Athletes are doing the same thing. NIL has turned thousands of athletes into entrepreneurs — signing endorsement deals, making appearances, running camps, selling merchandise and building businesses around their personal brands. So here’s some FREE legal advice for business owners — and athlete-entrepreneurs: THINK ABOUT WHETHER YOU SHOULD FORM AN LLC. ⚠️ If you’re doing business individually without forming a separate legal entity, you may essentially be operating as a sole proprietor. That can be simple. But simple isn’t always better. One of the biggest benefits of a limited liability company is right there in the name: LIMITED LIABILITY. An LLC is a separate legal entity under state law. Generally, the debts and liabilities of the LLC belong to the LLC — not automatically to its owners simply because they own the company. That can provide an important layer of protection between certain business liabilities and your personal assets. An LLC can also help you: ✅ Separate personal and business finances. ✅ Enter business contracts in the company’s name. ✅ Establish business banking and credit. ✅ Add additional owners or investors. ✅ Maintain cleaner accounting and records. ✅ Build a structure that can grow with the business. But an LLC isn’t a magic shield. It generally won’t protect you from your own wrongful conduct, obligations you personally guarantee or every other circumstance that can create personal liability. And forming an LLC doesn’t automatically create a tax advantage. The appropriate legal and tax structure depends on your circumstances. For athletes, the bigger lesson is this: Your NIL activity can become a business. Treat it like one. There’s a difference between making money and building a business. Whether you’re launching a company or monetizing your personal brand, think about the legal foundation you’re building on. ⚖️ — Christopher D. Not every athlete needs an agent—and not every agent is created equal. 💯 As NIL opportunities grow, athletes and families need to do their homework before choosing who represents them. NIL-agent regulation varies by state and continues to evolve. Louisiana recently expanded its athlete-agent laws to specifically regulate NIL representation (effective June 9, 2026, with its new registration process launching July 1). Bottom line: understand who you’re hiring, their experience and reputation, and exactly what you’re agreeing to before you sign. — Christopher D. Build wealth. Don’t just look wealthy. 💯 For young athletes earning NIL money, your greatest asset may not be how much you’re making—it’s TIME. Pay your taxes. Build an emergency fund. Invest early. Let compound growth work for you. NIL money may be temporary. The habits you build with it don’t have to be. 💰📈 — Christopher D.
