Case Reference: Meerut Central Market Demolition Matter
(Connected with Lokesh Kumar Khurana v. Rajendra Kumar Barjatya)

What happens when public pressure clashes with the Rule of Law?

In this matter, the Supreme Court raised a question that goes beyond illegal constructions—it strikes at the very core of constitutional governance:

“Will you succumb to hue and cry by encroachers, or will you go by the rule of law?”

This case is not just about demolition. It is about the survival of Rule of Law.

Rule of Law means:
✔️ No one is above the law.
✔️ Every public authority is bound by legal limits.
✔️ Judicial orders cannot be ignored because of convenience or public sentiment.

In Meerut, residential properties were allegedly converted into commercial spaces without proper approvals, raising serious concerns of public safety, urban planning violations, and administrative accountability.

When the demolition process was halted due to “public hue and cry,” the Supreme Court strongly intervened and reminded the administration that:

“The entire democracy stands on the Rule of Law.”

This principle has been protected in landmark judgments like Kesavananda Bharati v. State of Kerala (1973), where the Court held that Rule of Law forms part of the Basic Structure of the Constitution.

The message is clear:

If public officials begin acting on pressure instead of law, democracy shifts from constitutional governance to mob sentiment.

And that is where justice begins to collapse.

A powerful lesson for law students, lawyers, and public servants:

Law remains supreme—not because it is powerful, but because it keeps power under control.

What’s your take—should officers face personal liability for ignoring court orders?
