Cal/OSHA Standards Board Approves Indoor Heat Rule

The California Occupational Safety and Health (Cal/OSHA) Standards Board has unanimously approved a groundbreaking new rule addressing heat illness in indoor workplaces. This rule extends existing heat protections for outdoor workers to indoor environments, specifically targeting workplaces where temperatures exceed 82 degrees Fahrenheit. Despite the board's unanimous approval, the rule must still be sanctioned by the California Office of Administrative Law (OAL), a process that has previously encountered delays.

Final Approval and Implementation Timeline

The indoor heat illness rule is rooted in Senate Bill 1167, passed in 2016, which mandated Cal/OSHA to establish indoor heat regulations by January 2019. After numerous revisions, the rule still awaits final approval. The OAL has until early September 2024 to approve the rule, with an effective date anticipated by October 2024. Cal/OSHA is pushing for immediate approval and implementation, leveraging prior OAL reviews to expedite the process.

Key Provisions of the Indoor Heat Rule

The new rule mandates that employers in covered indoor workplaces develop a Heat Illness Prevention Plan (HIPP). This plan includes provisions for cool-down areas, emergency response procedures, and water availability. The rule applies to indoor work areas exceeding specific temperature thresholds and outlines exceptions for brief heat exposures and remote work. It also mirrors outdoor heat standards, requiring written plans and integrated training for both indoor and outdoor heat illness prevention. Employers must measure and record temperatures and heat indices, provide cool-down areas, ensure water access, and implement administrative controls to mitigate heat risks.
